The court may affirm the decision of the Hearing Examiner or <br /> remand the case for further proceedings; or it may reverse the <br /> 2 decision if the substantial rights of the petitioners may have been <br /> prejudiced because the administrative findings, inferences, conclu- <br /> 3 Bions, or decisions are: <br /> 4 a. In violation of constitutional provisions; or <br /> 5 b. In excess of the statutory authority or jurisdiction of <br /> the Hearing Examiner. <br /> 6 <br /> 7 Section 40: Rules and Regulations. <br /> 8 The City Treasurer's Office and the City's Police Department are authorized to <br /> 9 jointly promulgate rules and regulations necessary to administer this Ordinance and to <br /> 10 receive and account for all sums paid under this Ordinance. <br /> 11 Section 41: Construction. <br /> 12 This Ordinance shall be liberally construed to effectuate its purposes. <br /> 13 Section 42: Repealer. <br /> 14 A. The following ordinances or parts thereof are hereby repealed: Ordinance <br /> 15 No. 608-79; Ordinance No. 566-78; Ordinance No. 474-77; Ordinance No. 398-76; <br /> 16 Ordinance No. 366-75; Subsections 16 and 17 of Seciton 1 of Ordinance No. 470-77; <br /> 17 Ordinance No. 764-81. <br /> 18 B. Section 3 of Ordinance No. 459-77 is hereby repealed. Within Section 1 of <br /> 19 Ordinance No. 459-77, there are numerous RCW provisions adopted by reference <br /> 20 including those RCW provisions adopted by reference in Chapter 46.90 RCW. Of those <br /> 21 adopted by reference within Section 1, only the following RCW provisions are repealed: <br /> 22 <br /> RCW 46.16.380, RCW 46.61.570, RCW 46.61.575, RCW 46.61.600, <br /> 23 RCW 46.90.430, RCW 46.90.433, RCW 46.90.436, RCW 46.90.439, <br /> RCW 46.90.442, RCW 46.90.445, RCW 46.90.451, RCW 46.90.454, and <br /> 24 RCW 46.90.457. <br /> 25 <br /> The balance of Ordinance No. 459-77 is not repealed and shall remain in full force and <br /> 26 <br /> effect. <br /> 27 <br /> C. All ordinances or parts of ordinances in conflict herewith are hereby <br /> 28 <br /> repealed. <br /> 29 <br /> Section 43: The repeal by this Ordinance of any existing ordinances shall not <br /> 30 <br /> revive any ordinances heretofore repealed, nor affect any right existing or accrued, or <br /> 31 <br /> 32 -25- <br />
