Section 3: That this ordinance shall not become effective until the owners of <br /> the property abutting upon the street herein described have compensated the City of. <br /> Everett in an amount equal to one-half the current appraised value of the area herein <br /> 1 described. The abutting property owners shall have ninety (90) days following passage <br /> 2 of this ordinance to exercise this vacation. Unless otherwise amended by City Council, <br /> 3 this ordinance shall be null and void if the abutting property owners fail to exercise this <br /> 4 vacation within ninety (90) days following passage of this ordinance. <br /> 5 Section 4: That the City of Everett hereby retains an easement to construct, <br /> 6 reconstruct, operate, maintain, repair and replace all utilities under, over and across <br /> the following described legal description: <br /> 8 An easement 15 feet in width and being 7.5 feet on each side of the <br /> following described centerline: <br /> 9 <br /> Beginning at the Northeast corner of the West one-half of Block 33, J. S. <br /> 10 Sines Acre Tracts according to the plat thereof recorded in Volume 4 of <br /> Plats, page 11, records of Snohomish County, Washington, said point also <br /> 11 being on the West line of the alley within said plat; thence North along <br /> the Northerly projected West line of said alley, a distance of 27 feet, <br /> 12 more or less, to the true point of beginning; thence Westerly parallel to <br /> the North line of said Block 33, a distance of 55 feet, more or less; thence <br /> 13 angle 11-1/4° to the right for a distance of 59 feet, more or less, to a <br /> point of intersection with the Westerly line of the above-described <br /> 14 vacation and the terminus of this description. <br /> 15 The above legal description is intended to describe the centerline of the existing <br /> 16 City of Everett waterline. <br /> 17 The City of Everett further retains the right to grant to public and private <br /> 18 utilities the right to construct, reconstruct, operate, maintain, repair and replace <br /> 19 existing or proposed utility lines including, but not limited to, telephone, gas and <br /> 20 electrical, under, over and across the property above-described, together with the <br /> 21 following described parcel: <br /> 22 <br /> The South 15 feet of the North 76 feet of the East 22 feet of that portion <br /> 23 of 39th Street in Everett, Washington, lying east of SR 5 41st Street <br /> Interchange and west of a line which is parallel and 143.7 feet west of the <br /> 24 west line of Smith Avenue situated in the Southeast quarter of the <br /> Southwest quarter of Section 29, Township 29 North, Range 5 East, W.M. <br /> 25 <br /> The City further retains the right of access across adjoining properties for the purposes <br /> 26 <br /> set forth herein. <br /> 27 <br /> Section 5: That at all times all activities conducted in and around the herein <br /> 28 <br /> described easement shall be conducted so as not to interfere with, obstruct or endanger <br /> 29 <br /> the usefulness of any improvements, or other facilities, now or hereafter maintained <br /> 30 <br /> upon the easement or in any way interfere with, obstruct or endanger the City's use of <br /> 31 <br /> the easement. <br /> 32 <br /> -2- <br />
