Ce 0.3, 4 . • • 1 ORDINANCE NO. 7 7 y'- 83 2 AN ORDINANCE providing for the vacation of McGill Avenue from 2nd 3 Avenue S.E. easterly to 3rd Avenue S.E. 4 5 WHEREAS, the City Council of the City of Everett did, by Resolution No. 2321, 6 duly adopt and fix the 14th day of September, 1983, at 8:30 a.m., as the date for public 7 hearing; and 8 WHEREAS, due and legal notice of the time and place of said hearing and 9 determination of said resolution has been given by the City Clerk in the manner 10 prescribed by law; and 11 WHEREAS, at the time and place fixed for hearing, favorable statements and 12 objections to the vacating of the herein described street were heard and discussed; and 13 WHEREAS, RCW 35.79.030 authorizes the City to retain an easement in the 14 street which is vacated; and 15 WHEREAS, the City Council finds that it would not vacate the street could it 16 not retain an easement; and 17 WHEREAS, it now appears to the City Council of the City of Everett that the 18 said street resolved to be vacated should be vacated pursuant to the terms and 19 conditions of this ordinance; 20 NOW, THEREFORE, THE CITY OF EVERETT DOES ORDAIN: 21 Section 1: That the following described right-of-way: 22 That portion of McGill Avenue lying east of the Northerly projected West 23 line of Lot 8, Block 12, plat of Intercity Addition, Division No. 1, according to the plat thereof recorded in Volume 11 of Plats, page 9, 24 records of Snohomish County, Washington, and West of the Westerly right-of-way margin of 3rd Avenue S.E. 25 26 be and the same is hereby vacated pursuant to the conditions set forth in this ordinance. 27 Section 2: That the City of Everett shall not be responsible nor liable for 28 storm drainage runoff resulting from existing drainage patterns as established on City 29 rights-of-way that may currently, or in the future, go over, under or across the 30 above-described street vacation. 31 32
