• • • • • • 1 the adequacy or sufficiency of the plans and designs nor determine whether said 2 construction, work or activity is in conformance with other applicable plans, codes and 3 regulations. Further, agreement by the City to such construction, work or activity shall 4 not in any manner be considered as imposing any obligation, duty or liability upon the 5 City as to the safety or propriety of such construction, work or activity. 6 Section 7: The City is hereby authorized to cut, trim and remove any and all 7 brush, trees, other vegetation or debris upon the herein easement and the City has the 8 right of access across adjacent properties for such purposes. The City is also 9 authorized to cut, trim and remove any and all brush, trees, other vegetation and debris 10 on property adjacent to the easement which, in the City's reasonable judgment, 11 constitutes a hazard to the easement and the City has the right of access across 12 adjacent properties for such purposes. 13 Section 8: In the event any improvements are placed in/on the herein 14 described easement or anything is constructed in/on the easement without the written 15 approval of the City Engineer first having been obtained, all such activity shall cease 16 upon request of the City Engineer, and any and all improvements placed thereon 17 without the written agreement of the City Engineer shall be removed. In the event 18 prior approval is not obtained, the City is hereby authorized to remove any and all 19 improvements placed or constructed thereon and the City, its officers, employees and 20 agents are hereby held harmless from damage caused to said improvements from 21 removal thereof. The City is hereby authorized to charge for any and all costs incurred 22 by the City in removing the improvements. This right is in addition to any other right 23 the City may have at law or in equity. 24 Section 9: Violation Penalty. 25 a. Violation: Any person, firm or corporation, or association, or any agent 26 of any persons, firms, corporation or association who violates any provision of this 27 ordinance (or who fail to comply with any of the provisions herein) shall be deemed 28 guilty of a "violation" as is defined in the Everett Criminal Code and shall be punishable 29 by a fine not to exceed five hundred dollars ($500).
