I <br /> CITY OF EVERETT SPECIAL PROVISIONS <br /> item of Work. The Contractor shall execute Work in conformity with the standard <br /> practice of the trade. I <br /> 1-05.18(3) Responsibilities <br /> 1-05.18(3)A Manufacturers and Suppliers <br /> The Contractor shall be responsible for the adequacy, efficiency and sufficiency of111 <br /> manufacturers, Suppliers and their employees. <br /> 1-05.18(3)B Contractor's Employees <br /> The Contractor shall be responsible for the adequacy, efficiency and sufficiency of <br /> its employees. Workers shall have sufficient knowledge, skill and experience to <br /> perform properly the Work assigned to them. <br /> 1-05.18(3)C Payment for Labor and Materials111 <br /> The Contractor shall pay and require its Subcontractors to pay any and all <br /> accounts for labor including Worker's Compensation premiums, State <br /> Unemployment and Federal Social Security payments and other wage and salary <br /> deductions required by law. The Contractor also shall pay and cause its <br /> Subcontractors to pay any and all accounts for services, equipment, and materials <br /> used by him and its Subcontractors during the performance of Work under this <br /> Contract. The Contractor shall pay such accounts as they become due and <br /> payable. If requested by the City, the Contractor shall promptly furnish proof of <br /> payment of such accounts to the City. <br /> 1-05.18(3)D Attention to Work <br /> The Contractor, either in person or acting through its representative, shall give <br /> personal attention to and shall manage the Work so that it shall be prosecuted <br /> faithfully and completed under the Project schedule. When its representative is <br /> not personally present at the Project site, its designated alternate shall be <br /> available and shall have the authority to act in matters relating to this Contract. <br /> Where detailed construction requirements are not set forth in the Standard <br /> Specifications or these Special Provisions, the Contractor shall perform the Work <br /> of a quality comparable to the workmanship specified for other parts of the Work, <br /> from firms having established good reputations for similar Work, or by following <br /> industry standard practices. The Contractor shall perform all Work in compliance <br /> with and conforming to applicable building codes in effect at the time the Work is <br /> being performed. I <br /> 1-05.18(3)E Safety <br /> The Contractor alone shall be responsible for safety on the job site, including, but <br /> not limited to, the safety of its and its Subcontractor's employees. The Contractor <br /> shall maintain the Project site and perform the Work in a manner that meets the <br /> City's responsibility under statutory and common law for the provision of a safe <br /> place to work. <br /> 1-05.18(3)F Threats, Intimidation and Harassment Forbidden <br /> Contractor shall not allow its employees, its Subcontractors, its Subcontractors' <br /> employees, or any other agents to threaten bodily injury or property damage, to <br /> intimidate or attempt to intimidate any person, or to assault or physically harass <br /> any person. Forbidden conduct includes, but is not limited to, threatening, <br /> appearing, or actually doing any of the following: pushing, shoving, striking, <br /> physically blocking a person or a person's vehicle, vandalism, malicious mischief, <br /> or any other act that a reasonable person would understand be intended to <br /> intimidate, cause personal injury, or cause property damage.
