• <br /> k. Preliminary plats as prescribed by the State and City subdivision <br /> laws, except for those preliminary plats exceeding 75 lots in size. <br /> 1. Shoreline Management Substantial Development, Conditonal Use or <br /> Variance Permit for projects from one to five acres in size and <br /> shoreline management substantial development permits for the <br /> following utility improvements: water supply distribution and <br /> storage facilities, sanitary sewage (and storm drainage when in a <br /> combined system) transmission and treatment facilities, and storm <br /> water drainage systems. All other utility facilities shall be under <br /> the jurisdiction of the Everett Planning Commission. <br /> m. Planned residential developments except for proposed <br /> developments exceeding 50 residential units in size. <br /> n. Special property use permits. <br /> o. Conditional use permits. <br /> p. In situations where a planned residential development is combined <br /> with a preliminary subdivision procedure, the Hearing Examiner <br /> shall have jurisdiction over the entire procedure if the preliminary <br /> subdivision is 50 lots or less, or if the planned residential <br /> development is 50 units or less. <br /> 2. Jurisdiction Retained by Planning Commission. Under the provisions of <br /> City Ordinance 3-68 and RCW 35.63, the Planning Commission shall <br /> retain jurisdiction for all applications for development not assigned to <br /> the Hearing Examiner by this Ordinance. <br /> B. Decision and Conditions <br /> 1. The Examiner's decision may be to grant or deny the application, or the <br /> Examiner may require of the applicant such conditions, modifications and <br /> restrictions as the Examiner finds necessary to make the application <br /> compatible with its environment and carry out the objectives and goals <br /> of the Comprehensive Plan, Shoreline Management Master Program, <br /> Housing Assistance Plan, other applicable plans and programs adopted by <br /> the City Council, the Zoning Ordinance, the Subdivision Ordinance, and <br /> other codes and ordinances of the City of Everett. Conditions, <br /> modifications and restrictions which may be imposed are, but are not <br /> limited to: <br /> a. Exact location and nature of development, including additional <br /> building and parking area setbacks, screenings in the form of <br /> landscaped berms, landscaping, or fencing. <br /> b. Measures to mitigate the adverse environmental impacts of the <br /> development <br /> c. Hours of use or operation or type and intensity of activities <br /> d. Sequence and scheduling of development <br /> e. Maintenance of the development <br /> f. Duration of use and subsequent removal of structures <br /> g. Granting of easements and dedications for roads, walkways, <br /> utilities or other purposes and dedication of land or other provisions <br /> for public facilities, the need for which the Examiner finds would <br /> be generated in whole or in significant part by the proposed <br /> development <br /> � I <br /> -4- <br />
