ORDINANCE NUMBER 9_7-5/- P,3 AN ORDINANCE creating a special construction fund entitled "Design and Construction of Merrill-Ring Creek Regional Detention Facility Fund No. 340" and authorizing the design and construction of the regional detention facility. WHEREAS, the Comprehensive Drainage Plan recommends a regional detention facility at this location (see Exhibit "A" attached) ; and WHEREAS, a regional detention facility will benefit downstream property owners and the receiving stream; and WHEREAS, on November 8 , 1982 , the City signed an Airspace Lease Agreement for Construction, operation and maintenance of a regional detention facility at this location; and WHEREAS, a regional detention facility at this location is a more cost effective method to detain stormwater runoff from Casino Road; and WHEREAS , there is a need to detain stormwater runoff from the Casino Road LID; NOW, THEREFORE, BE IT ORDAINED BY THE EVERETT CITY COUNCIL THAT: Section 1 : A special construction fund is hereby established as Fund No. 340 "Design and Construction of Merrill-Ring Creek Regional Detention Facility" to accomplish the actions authorized in subsequent sections of this ordinance. Section 2 : Authorization is hereby given to design and con- struct the Merrill-Ring Creek Regional Detention Facility. Section 3 : The total estimated cost of the improvements hers- in authorized is $70 , 000 which will include all costs related to design, construction, contract administration, plan development and associated costs. Section 4 : The Public Works Director of the City of Everett, under administration of the Mayor , is hereby given the responsi- bility of conducting all tasks outlined under Section 2 above. Section 5 : The sum of $70 , 000 is hereby appropriated to Fund No. 340 "Design and Construction of Merrill-Ring Creek Regional Detention Facility" . 1 Program 773-780
