• <br /> 1 ORDINANCE NO. %? 9-C-2 <br /> 2 <br /> 3 AN ORDINANCE defining and establishing the crime of prostitution and <br /> prostitution loitering and establishing the punishments therefor. <br /> 4 <br /> 5 <br /> THE CITY OF EVERETT DOES ORDAIN: <br /> 6 <br /> Section 1: A person is guilty of "prostitution" if such person engages in or <br /> 7 <br /> agrees or offers to engage in sexual conduct with another person in return for a fee. <br /> 8 <br /> Section 2: A person commits the offense of "prostitution loitering" if he or <br /> 9 <br /> she remains in a public place and intentionally solicits, induces, entices or procures <br /> 10 <br /> another to prostitution. Among the circumstances which may be considered in <br /> 11 <br /> determining whether a person intentionally solicits, induces, entices or procures another <br /> 12 <br /> to commit prostitution are: <br /> 13 <br /> 14 1. Repeatedly beckoning to, stopping, or attempts to stop or engage <br /> passersby in conversation; or <br /> 15 <br /> 2. Repeatedly stopping or attempting to stop motor vehicle operators <br /> 16 by hailing, waving of arms or other bodily gestures; or <br /> 17 3. Being a known prostitute or panderer. "Known prostitute or <br /> panderer" means a person who within one year previous of date of <br /> 18 arrest for any violation hereof is known by the arresting officer to <br /> have been convicted of an offense involving prostitution. <br /> 19 <br /> 20 Section 3: For purposes of this Ordinance, "sexual conduct" means sexual <br /> 21 intercourse in the ordinary meaning thereof, or any touching of the sexual or other <br /> 22 intimate parts of a person done for the purpose of gratifying sexual desire of either <br /> 23 party, whether such persons are the same or opposite sex. <br /> 24 Section 4: For purposes of this Ordinance, "public place" means an area <br /> 25 generally visible to public view, and includes streets, sidewalks, bridges, alleys, plazas, <br /> 26 parks, driveways, parking lots, automobiles (whether moving or not), and buildings open <br /> 27 to the general public, including those which serve food or drink or provide entertain- <br /> 28 ment, and the doorways and entrances to buildings or dwellings and the grounds <br /> 29 enclosing them. <br /> 30 <br /> 31 <br /> 32 <br />
