CITY <br /> LICENSE TO USE CITY PROPERTY <br /> THIS LICENSE AGREEMENT (the"License"), between the City of Everett as <br /> Grantor(the"City)and Hope Works Social Enterprises, dba Ground Works Landscaping <br /> Services (a 501c3 non-profit), 3331 Broadway Ave, Everett, WA 98201, as the Grantee <br /> ("Ground Works"), relates to an approximately 0.5 acre portion of property owned by the <br /> City located at 4000 Railway Ave, Everett, WA(the"Property"). <br /> RECITALS <br /> *A. Ground Works desires to utilize property owned by the City for storage of <br /> materials and equipment. <br /> B. The City is willing to grant Ground Works authority to use the City's <br /> property upon certain terms and conditions. <br /> AGREEMENT <br /> In consideration of mutual benefits and other good and valuable consideration,the receipt <br /> and sufficiency of which is hereby expressly acknowledged,the City licenses Ground <br /> Works to use the Property upon the following terms and conditions: <br /> Section 1. LICENSED PROPERTY. The specific area of property owned by the <br /> City, and subject to this License, is an area approximately one half of one acre in size and <br /> is more fully set forth as depicted in Exhibit A, attached hereto, or as otherwise directed <br /> by the City's on-site supervisor Mike Hale or other city designee. <br /> Section 2. TERM. This License shall be effective beginning April 13, 2018, and <br /> shall expire on March 31, 2019,unless terminated earlier upon 30-days' notice per <br /> Section 7, below. <br /> Section 3. FEE. Ground Works shall pay shall pay$550.00 per half acre, due each <br /> month on or before the 1st day of each month during the term of this License beginning <br /> on May 1st,plus Lease Hold Tax at a rate of 12.84%, if applicable, for the use of City's <br /> Property. The month of April shall be prorated and a payment of$329.99, plus Lease <br /> Hold Tax at a rate of 12.84%, if applicable is required for the partial month of April. <br /> Section 4. AUTHORIZED USE. Ground Works may only use the Property for the <br /> purpose of its operations office and the storing, maintaining, loading, and unloading of <br /> materials and equipment relative to the operations of Ground Works.
