CITY LICENSE TO USE CITY PROPERTY THIS LICENSE AGREEMENT (the"License"), between the City of Everett as Grantor(the"City)and Hope Works Social Enterprises, dba Ground Works Landscaping Services (a 501c3 non-profit), 3331 Broadway Ave, Everett, WA 98201, as the Grantee ("Ground Works"), relates to an approximately 0.5 acre portion of property owned by the City located at 4000 Railway Ave, Everett, WA(the"Property"). RECITALS *A. Ground Works desires to utilize property owned by the City for storage of materials and equipment. B. The City is willing to grant Ground Works authority to use the City's property upon certain terms and conditions. AGREEMENT In consideration of mutual benefits and other good and valuable consideration,the receipt and sufficiency of which is hereby expressly acknowledged,the City licenses Ground Works to use the Property upon the following terms and conditions: Section 1. LICENSED PROPERTY. The specific area of property owned by the City, and subject to this License, is an area approximately one half of one acre in size and is more fully set forth as depicted in Exhibit A, attached hereto, or as otherwise directed by the City's on-site supervisor Mike Hale or other city designee. Section 2. TERM. This License shall be effective beginning April 13, 2018, and shall expire on March 31, 2019,unless terminated earlier upon 30-days' notice per Section 7, below. Section 3. FEE. Ground Works shall pay shall pay$550.00 per half acre, due each month on or before the 1st day of each month during the term of this License beginning on May 1st,plus Lease Hold Tax at a rate of 12.84%, if applicable, for the use of City's Property. The month of April shall be prorated and a payment of$329.99, plus Lease Hold Tax at a rate of 12.84%, if applicable is required for the partial month of April. Section 4. AUTHORIZED USE. Ground Works may only use the Property for the purpose of its operations office and the storing, maintaining, loading, and unloading of materials and equipment relative to the operations of Ground Works.
