2 <br /> R-3, Multiple Family Medium Density zone as established by the City of Everett. <br /> (Exhibit#5, Snohomish County Assessors Record dated June 29, 2016) (Exhibit#6, <br /> Go Sync Maps) <br /> 2. On May 23, 2016, City of Everett Code Enforcement Officer Spring Wathen <br /> inspected the property and observed and photographed the residential structure on <br /> site that was boarded and secured from trespass but not maintained in a clean and <br /> sanitary manner. Vegetation in the yards of the property exceeded the maximum <br /> allowed height of 12 inches; the exterior walls of the structure were tagged with <br /> graffiti and furniture was discarded in the front and rear yards of the property. <br /> These violations in public view are annoyances and disrupt and injure the comfort, <br /> repose, health and safety of others. The entire community is affected by the activity. <br /> (Exhibit#1i-1r, Inspection Photos dated May 23, 2016) (Testimony of Code <br /> Enforcement Officer Wathen) <br /> 3. Because of previous enforcement actions on the property, the City issued a <br /> violation citation to the Respondents on June 1, 2016 for violations of International <br /> Property Maintenance Code (IPMC) 301.2 Responsibility as adopted by EMC <br /> 16.005.010; IPMC 301.3 Vacant Structures and Land as adopted by EMC <br /> 16.005.010; IPMC 108.1.5(7) Dangerous Structure or Premises as adopted by EMC <br /> 16.005.010; IPMC 106.1 Unlawful Acts as adopted by EMC 16.005.010 and Everett <br /> Municipal Code (EMC) 8.20.020(A)(C)(E)(F) Nuisances. Copies were mailed to the <br /> Respondents via first class and certified mail to the Respondents last known <br /> address which Officer Wathen obtained from Snohomish County Assessors Record. <br /> A copy was posted at the property. Each method of service used is independently <br /> sufficient to provide notice. (Pursuant to EMC 1.20.010.C.1) (Exhibit#3, Violation <br /> Citation dated June 1, 2016 with mail receipts) (Exhibit#4, Declaration of Service <br /> dated June 1, 2016 with photo)(Testimony of Code Enforcement Officer Wathen) <br /> 4. On June 28, 2016, Officer Wathen reinspected the property and observed and <br /> photographed that overgrown vegetation in the front yard had been cut and the <br /> couch removed. However, the graffiti tagging remained on the exterior wall and <br /> discarded items and overgrown vegetation remained in the rear yard of the property <br /> in public view. (Exhibit#1a-1h, Inspection Photos dated June 28, 2016) (Testimony <br /> of Code Enforcement Officer Wathen) <br /> 5. The City provided the Respondents with an opportunity to correct the conditions that <br /> were in violation of sections of the EMC, provided a corrective action date of June <br /> 30, 2016 and provided notice of the date, time and place of this hearing. The <br /> Respondents failed to appear at the hearings. <br /> Based on the above Findings of Fact, the Violations Hearing Examiner enters the <br /> following Conclusions: <br />
