In addition to the other requirementsthe of this Section 10, if the <br /> sole Granto the CityFees that the Grant Recipient is not an employee Recipient w woroker <br /> under Chapter 51 of the Revised Code of Was <br /> Work performed in accordance with this Agreement, by certifyingon' �e�� in <br /> to the following;surani' for the <br /> (1) The Grant Recipient is free from control or direction over <br /> of the Work; and <br /> the performance <br /> will not (2) The Work performed is outside the usual course of business <br /> the costsnbe Pe principal edtp��of fusiness of the City, ant for the City or <br /> business from which thork is perfomed;Recipient responsible for <br /> (3) The Grant Recipient is customarily engaged in an independently <br /> business of the same nature as the Work performed, or has a principal place of business <br /> Work performed that is eligible for a business deduction for feder P � for the <br /> tly established <br /> n <br /> al income tax purposes; and <br /> (4) On the effective date of this Agreement, the Grant Recipient is re <br /> for filing a schedule of expenses, for the next applicable <br /> Servicelifroma the responsible <br /> type of service performed; and(5) filing period, with the Internal Revenue <br /> thereafter, the Grant Recipient he effective date <br /> of this Agreement or within a reasonable time <br /> other state agencies, where required, for theeWork performed for the payment Department of Revenue and <br /> y paid by employers and businesses and has registered for and received a unified <br /> identifier number from the State of Washington; state taxes <br /> and business <br /> (6) By the effective date of this Agreement, the Grant Recipient maintains <br /> a <br /> separate set of records that reflect all items of income and expenses of the Work performed. <br /> C. Any and all employees of the <br /> of any Work, shall be considered employees of only the RecipientGrant t � l and <br /> City. The Grant Recipient shall be solely liable for anyandengagede in the performance <br /> under the Worker's Compensation Act on behalf of said e not employees of the <br /> all claims that may or might not arise <br /> so engaged and for any and all claims made by a third employees or the Grant Recipient, while <br /> or omission on the part of the Grant Recipient's employees,while so as a gaged of any o f the Wt ract <br /> k. <br /> engaged on any of the'Work. <br /> D. The Grant Recipient shall comply <br /> Standards Act and other legislation affecting its employees with applicable th �s and re f the Fair Labor <br /> thereunder insofar as applicable to its employees and shall at all times save the City <br /> ear, <br /> and harmless from all actions,claims,demands,and expenses regulations issued <br /> P arising out of said act,and rulesand <br /> regulations that are,or may be,promulgated in connection therewith. <br /> E. The Grant Recipient assumes full responsibility for the a <br /> use, sales, income, or other forms of tax (such as state and city business and occupation <br /> payment of all payroll taxes, <br /> fees, licenses, excises, or payments required byanyP taxes), <br /> now,or may be,during the term of the Agreement,enactedeas to all persons emor local loed legislation t which are <br /> employed by the Grant <br /> Page 4 of 7 <br />
