applicable laws and the Snohomish County Charter. In the event funding becomes unavailable for <br /> work to be performed pursuant to this Agreement, all work shall terminate in accordance with <br /> provisions of this Agreement upon the last day of funding. <br /> 3. SCOPE OF WORK <br /> A. The County shall furnish the necessary personnel, equipment, material and/or services and <br /> otherwise do all things necessary for or incidental to the performance of the work set forth in <br /> Appendix A, attached hereto and incorporated herein. <br /> B. The County will not be required to perform work for the City in excess of work specified in <br /> the Appendices except by mutual agreement to a written amendment to this Agreement. <br /> 4. PERFORMANCE <br /> The County agrees to satisfy all aspects of this Agreement, including the Appendices, in a timely <br /> and professional manner. At any time that the County cannot fulfill its responsibilities under this <br /> Agreement,the County shall notify the City thereof in writing,together with an explanation of why <br /> said responsibilities cannot be fulfilled. <br /> 5. ADMINISTRATION OF AGREEMENT <br /> Each party to this Agreement shall designate an individual who may be designated by title or <br /> position to oversee and administer such party's participation in this Agreement. The parties' initial <br /> Administrators shall be the following individuals: <br /> County's Initial Administrator: City's Initial Administrator: <br /> Gregg Farris, Interim SWM Director Heather Griffin, P.E. <br /> Snohomish County Dept. of Public Works City of Everett Public Works Department <br /> 3000 Rockefeller Ave, M/S 607 3200 Cedar Street <br /> Everett, WA 98201 Everett, WA 98201 <br /> 6. COMPENSATION <br /> A. The City shall reimburse the County for all labor charges including an administrative fee for <br /> the costs associated with the services provided by the County. The County agrees that only <br /> those costs directly allocable to the services under accepted accounting procedures will be <br /> charged to the City. <br /> B. For the purpose of fixing the compensation to be paid by the City to the County for the Services <br /> under this Agreement, it is agreed that there shall be included in the billing, to cover <br /> administrative costs, an administrative fee not to exceed the County administrative rate. This <br /> rate is currently set at 20% of the total labor and benefits cost to the County for only those <br /> County employees performing services for the City under this agreement. This rate may be <br /> reasonably adjusted annually to reflect changes in actual administrative costs without the need <br /> for formal amendment of this Agreement. <br /> C. The compensation due to the County under this Agreement shall in no event exceed Nine <br /> Thousand dollars ($9,000.00)as shows in Appendix B. <br /> 7.
