• (;(der gy, /2.. • • ORDINANCE NO. 9/‘-.72"--- AN /(o-. 2"AN ORDINANCE creating a special construgtion fund entitled I( "Riverside Area Outfall Interception Facilities Construction Fund", Fund No. 357, authorizing the design and construction of sewer facilities to intercept outfalls in the Riverside area. WHEREAS, the City Council has recognized the need to improve the sewer system of the City of Everett by intercepting the remaining raw sewage out- falls which discharge to the Snohomish River; and WHEREAS, the City Council recognizes that future development or re- development in the Riverside area is severely restricted due to lack of ji Ili adequate sewer service to the area; and WHEREAS, there will be benefits to the health and welfare of all citizens of the City of Everett as a result of intercepting the remaining outfalls; and WHEREAS, the "Lower Snohomish Basin 201 Facilities Plan" called for the interception of the Riverside area outfalls; and • WHEREAS, the City Council on August 15, 1979 passed Ordinance No. 627-79 e � which increased the sewer rates within the City to contribute funds toward 0 f improvement of the City's sewer system; and WHEREAS, the City Council on February 27, 1980 passed Ordinance No. 669-80 on July 30, 1980 passed Ordinances No. 714-80 and No. 715-80, on August 13, 1980 passed Ordinance No. 722-80, and on September 9, 1981 passed Ordinance No. 803-81 all establishing sewer connection charges for new construction in the City to help fund needed sewer system improvements throughout the City; and ; WHEREAS, the State of Washington Department of Ecology has offered the City a grant for 50% of the cost of constructing the needed facilities; NOW, THEREFORE, BE IT ORDAINED BY THE EVERETT CITY COUNCIL THAT: Section 1: A construction fund is hereby established as Fund No. 357 entitled "Riverside Area Outfall Interception Facilities Con- struction Fund" to accomplish the actions authorized in subsequent sections of this ordinance. Section 2: Authorization is hereby granted to the Public Works Director to intercept the raw sewage outfalls in the Riverside area and to provide for planning, design, construction, and contract administration necessary to accomplish this task. The City is authorized to acquire all materials, equipment, personal and real property interest therein, easements, franchises, and rights-- , of-way necessary to carry out the above-described plans.
