• • ORDINANCE NO. '7/1� AN ORDINANCE annexing certain property to the City of Everett. WHEREAS, pursuant to R.C.W. 35.13.130, a petition was presented to the City Council of the City of Everett proposing the annexation of certain property; and WHEREAS, the petition which was filed pursuant to R.C.W. 35.13.130 was signed by owners of not less than seventy-five percent in value according to the assessed valuation for general taxes of the property proposed to be annexed; and WHEREAS, the Council of the City of Everett, a municipal corporation, did fix the 14th day of June, 1982, and continued until July 21, 1982, for hearing upon said petition, and cause notice of hearing to be published in one issue of the Daily Herald, a newspaper of general circulation in the City, and caused said notice also to be posted in three places within the territory proposed for annexation, which notice as published and as posted specified the time and place of hearing and invited interested persons to appear and voice approval or disapproval of the annexation; and WHEREAS, following the hearing, the Council of the City of Everett, a municipal corporation, have determined to annex all of the property described in the petition as hereinafter set forth; WHEREAS, the Snohomish County Boundary Review Board invoked jurisdiction at their September 14, 1982, regular meeting, and set October 18, 1982, as the public hearing and continued the public hearing until November 15, 1982; WHEREAS, on November 15, 1982, following the hearing the Boundary Review Board action was a 2 to 2 tie to disapprove the annexation and the City Attorney has provided an opinion that, unless the Board takes action to disapprove the annexation, under R.C.W. 36.43.150, the City Council shall proceed to consider the annexation for final approval.
