S)? 9- S �: <br /> 2 <br /> 3 AN ORDINANCE authorizing the condemnation of real property for the <br /> construction of certain sewer improvements to serve the southwest <br /> 4 area of the City of Everett. <br /> 5 <br /> 6 WHEREAS, the City Council of the City of Everett finds as follows: <br /> 7 1. Resolution No. 1924 and Ordinance No. 782-81, as amended, of the City <br /> 8 of Everett have ordered the construction of certain sewer improvements to serve the <br /> 9 southwest area of the City as illustrated in Exhibit A, attached hereto and incorporated <br /> 10 herein by reference, which improvements include acquisition of property easements and <br /> 11 rights-of-way; and <br /> 12 2. Said Resolution No. 1924 and Ordinance No. 782-81 have established an <br /> 13 LID to finance part of the costs of said improvements; and <br /> 14 3. Pursuant to said resolution and ordinance, the City engaged the services <br /> 15 of CH2M Hill, Consulting Engineers, to design said sewer improvement and to establish <br /> 16 and design the route for the said sewer line from the southwest area of the City to the <br /> 17 City's sewer treatment lagoon in the northwest area of the City. <br /> 18 4. Further, pursuant to said resolution and ordinance, City staff have <br /> 19 acquired right-of-way for said sewer improvements by negotiation with various <br /> 20 property owners in the route of the sewer transmission line established by the design of <br /> 21 the City's Enginering Consultants, CH2M Hill; and <br /> 22 5. The property described in Exhibit B, attached hereto and incorporated <br /> 23 herein by reference, is sought to be acquired for the construction of the sewer line to <br /> 24 serve the southwest area of the City; <br /> 25 6. The public interests of the City of Everett require that the property <br /> 26 shown in Exhibit B be acquired for permanent public use as a right-of-way for sewer <br /> 27 line and appurtenances to serve the citizens of Everett. <br /> 28 NOW, THEREFORE, THE CITY OF EVERETT DOES ORDAIN: <br /> 29 Section 1: That the City Council of the City of Everett does hereby authorize <br /> 30 the Public Works Department to acquire, if necessary, by condemnation, in accordance <br /> 31 with the laws of the State of Washington and applicable and current City ordinances, <br /> 32 <br />
