1 ORDINANCE NO. 93—8 <br /> 2 <br /> AN ORDINANCE relating to permits for work on the public right-of-way, <br /> 3 amending Section 1 of Ordinance No. 2204 and repealing Ordinance <br /> No. 1213. <br /> 4 <br /> 5 <br /> WHEREAS, the City Council finds that there exists a need to eliminate the <br /> 6 <br /> specific deposit requirements for work on public right-of-way and to require permits <br /> 7 <br /> for all work done within the public right-of-way; and <br /> 8 <br /> WHEREAS, the City Council finds that it is not necessary to mandate by <br /> 9 <br /> ordinance the specific save harmless language which is to be included in permits for <br /> 10 <br /> work on public right-of-way and thereby deem it appropriate to repeal Ordinance No. <br /> 11 <br /> 1213; <br /> 12 <br /> NOW, THEREFORE, THE CITY OF EVERETT DOES ORDAIN: <br /> 13 <br /> Section 1: Section 1 of Ordinance No. 2204 which reads as follows: <br /> 14 <br /> 15 "It shall be unlawful for any person other than a duly authorized officer, <br /> agent or employee of the City of Everett, to make any opening in any <br /> 16 sidewalk or pavement on any of the alleys or public streets of the City of <br /> Everett without having first obtained a permit from the Commissioner of <br /> 17 Public Works so to do. Before any permit will be issued for any of the <br /> above named purposes, a deposit shall be made with the City Treasurer in <br /> 18 the sum of $25.00 for each opening of one square yard or less, and an <br /> additional deposit of $10.00 for each and every additional square yard or <br /> 19 fractional part thereof. If openings are maintained and repaired by the <br /> City, the entire deposit shall be forfeited to the City. The repair of any <br /> 20 sidewalk or pavement, and the back filling of all tunnels under permit <br /> from the City so to do, shall be made under the supervision, and subject to <br /> 21 the approval of the Commissioner of Public Works. Repair of pavement <br /> shall extend six inches below, and six inches under the pavement around <br /> 22 all openings. Repairs of sidewalk shall extend two inches below and three <br /> inches under the sidewalk around all openings. All repairs made under the <br /> 23 provision of the Ordinance shall be completed within thirty days, or the <br /> deposit made for permit will be forfeited. Tunnels made under the <br /> 24 provisions of this Ordinance shall be back filled and inspected by a duly <br /> authorized officer, agent or employee of the City before the pavement or <br /> 25 sidewalk above same is replaced." <br /> 26 be and the same is hereby amended to read as follows: <br /> 27 <br /> 28 "It shall be unlawful for any person other than a duly authorized officer, <br /> agent or employee of the City of Everett, to place any improvements, <br /> 29 construct anything, do any work or make any openings in, on or under any <br /> City of Everett alley or street, or within the right-of-way of the City of <br /> 30 Everett without first having obtained a permit from the City of Everett <br /> Public Works Department, paid the required fee and complied with all <br /> 31 rules and regulations established by the Director of Public Works." <br /> 32 <br />
