• <br /> • <br /> 1 ORDINANCE NO. 5'8 J- S'- <br /> 2 <br /> AN ORDINANCE regulating groups or assemblies in City parks and <br /> 3 repealing Section 12 of Ordinance No. 3471. <br /> 4 <br /> 5 <br /> WHEREAS, the Everett City Council finds that regulation of large groups and <br /> 6 <br /> assemblies in City parks to promote the general safety and welfare of public; and <br /> 7 <br /> WHEREAS, the Everett City Council finds that regulation of groups and <br /> 8 <br /> assemblies is necessary to promote efficient utilization of the limited space and <br /> 9 <br /> facilities available in City parks and to attempt to avoid conflicts between park users; <br /> 10 <br /> and <br /> 11 <br /> WHEREAS, the Everett City Council deems it to be in the public interest to <br /> 12 <br /> make the City parks available, subject to limited space and facilities, to all who desire <br /> 13 <br /> to use them; <br /> 14 <br /> NOW, THEREFORE, THE CITY OF EVERETT DOES ORDAIN: <br /> 15 <br /> Section 1: That Section 12 of Ordinance No. 3471 (EMC 9.06.110) which reads <br /> 16 <br /> as follows: <br /> 17 <br /> 18 "It is unlawful to hold, or participate in, any religious or political meeting <br /> or other assembly in any park, without the written permission of the park <br /> 19 board to do so." <br /> 20 is hereby repealed in its entirety. <br /> 21 Section 2: City parks and recreational facilities shall be available for any <br /> 22 group or assembly on a first come, first serve basis. Groups or assemblies calculated to <br /> 23 attract a large number of people, relative to the size and capacity of the park or <br /> 24 facility must, prior to the event, reserve the space. A large group or assembly is that <br /> 25 which would occupy one-tenth (1/10th) or more of the user capacity of the park or <br /> 26 facility. <br /> 27 Section 3: Reservations as required in Section 2 herein shall be made by <br /> 28 obtaining a written permit through the Office of the Director of Parks and Recreation. <br /> 29 A permit may be obtained by submitting a written application to the Director's Office, <br /> 30 at least fourteen working days prior to the day of the intended use.
