• • 1 ORDINANCE NO. 5'8 J- S'- 2 AN ORDINANCE regulating groups or assemblies in City parks and 3 repealing Section 12 of Ordinance No. 3471. 4 5 WHEREAS, the Everett City Council finds that regulation of large groups and 6 assemblies in City parks to promote the general safety and welfare of public; and 7 WHEREAS, the Everett City Council finds that regulation of groups and 8 assemblies is necessary to promote efficient utilization of the limited space and 9 facilities available in City parks and to attempt to avoid conflicts between park users; 10 and 11 WHEREAS, the Everett City Council deems it to be in the public interest to 12 make the City parks available, subject to limited space and facilities, to all who desire 13 to use them; 14 NOW, THEREFORE, THE CITY OF EVERETT DOES ORDAIN: 15 Section 1: That Section 12 of Ordinance No. 3471 (EMC 9.06.110) which reads 16 as follows: 17 18 "It is unlawful to hold, or participate in, any religious or political meeting or other assembly in any park, without the written permission of the park 19 board to do so." 20 is hereby repealed in its entirety. 21 Section 2: City parks and recreational facilities shall be available for any 22 group or assembly on a first come, first serve basis. Groups or assemblies calculated to 23 attract a large number of people, relative to the size and capacity of the park or 24 facility must, prior to the event, reserve the space. A large group or assembly is that 25 which would occupy one-tenth (1/10th) or more of the user capacity of the park or 26 facility. 27 Section 3: Reservations as required in Section 2 herein shall be made by 28 obtaining a written permit through the Office of the Director of Parks and Recreation. 29 A permit may be obtained by submitting a written application to the Director's Office, 30 at least fourteen working days prior to the day of the intended use.
