TERMINATION OF CONCOMITANT AGREEMENT <br /> TO REZONE ORDINANCE NO. 888-82 <br /> THIS TERMINATION OF CONCOMITANT AGREEMENT made and entered <br /> into this /9'** day of *fern/Der. , 1997, by and between the <br /> City of Everett, a municipal corporation, (the "City" <br /> hereinafter) and Marc Bhend and Joan Esther Bhend, husband <br /> and wife, owners of certain property located in the City of <br /> Everett (the "Owners" hereinafter) <br /> WITNESSETH <br /> WHEREAS, Owners are the owners of a 40 acre parcel of land <br /> in southwest Everett, Washington (hereinafter the <br /> "Property") ; and <br /> WHEREAS, in accordance with Ordinance No. 888-82, Owners <br /> entered into a concomitant agreement (hereinafter the <br /> "Agreement") with the City for a contract rezone of the <br /> Property to M-M (Business Park) which was executed on <br /> October 11, 1982; and <br /> WHEREAS, Owners have applied for a rezone of the Property <br /> from M-M zoning designation to M-1 (Office and Industrial <br /> Park) which would require the repeal of Ordinance No . 888-82 <br /> and the termination of the Agreement if the requested rezone <br /> were granted; and <br /> WHEREAS, a public hearing was held before the City Council <br /> on November 19, 1997, to consider the adoption of the <br /> ordinance rezoning the Property and termination of the <br /> Agreement by means of this document; <br /> NOW, THEREFORE , THE PARTIES MUTUALLY AGREE AS FOLLOWS: <br /> Section 1 : The City Council has granted the Owners' <br /> requested rezone of the Property to M-1 which is legally <br /> described as follows : <br /> Parcel A: the SE of the NW of Section 3, Township 28N, <br /> R. 4, E.W.M. except portion conveyed to the City of Everett <br /> by and recorded in Volume 3. 4 of Deeds, on p 381, under A. F. <br /> #1872524 <br />
