• <br /> • <br /> 1 against the City for damages arising out of tortious conduct until a claim <br /> has been presented to and filed with the clerk of the City of Everett. The <br /> 2 omission to present any such claim shall be a bar to any action against the <br /> City therefor. The requirements to file a claim shall not affect the <br /> 3 applicable period of limitations within which an action must be <br /> commenced, but such period of limitations shall begin and shall continue <br /> 4 to run as if no claim were required. Neither the Council, nor any <br /> department, board, officer, or authority, shall allow, make valid, or in any <br /> 5 manner recognize any demand against the City which was not at the time <br /> of its creation a valid claim against the City; nor shall they or any of <br /> 6 them ever allow or authorize to be paid any demand which without such <br /> action, would be invalid or which shall have been barred by any statute of <br /> 7 limitations or for which the City was never liable; and any such action <br /> shall be null and void." <br /> 8 <br /> 9 Section 2: The Charter amendment proposed in Section 1 hereof shall be <br /> submitted for ratification by the electors of the City of Everett at an election to be <br /> 10 held on November 2, 1982, at which election the issue shall be stated in substantially <br /> 11 the form as follows: <br /> 12 <br /> CITY OF EVERETT <br /> 13 PROPOSED CHARTER AMENDMENT <br /> 14 <br /> 15 Shall the requirement of Section 15.4 of the Everett City Charter that <br /> claims against the City be filed within 120 days, which has been ruled to <br /> 16 be an unconstitutional time limitation, be amended to comply with State <br /> law? <br /> 17 <br /> 18 Charter Change YES / / <br /> 19 Charter Change NO / / <br /> 20 <br /> 21 <br /> 22 i/ ,„„iaara <br /> 23 MAYOR <br /> 24 ATTEST: <br /> 25 <br /> 26 CITY CLERK <br /> 27 <br /> 28 Passed: 9'- /.c 2'07-- <br /> 29 Valid: 9 - S'- <br /> 30 Published: 9 - 7- A <br /> 31 <br /> 32 <br />
