4 1 ORDINANCE NO. 2 AN ORDINANCE amending Ordinance No. 295-74, Chapter 1, § 3 3 (EMC 5.04.030) requiring businesses to pay business and occupation tax regardless of whether they qualify for a business license. 4 5 6 WHEREAS, City Council finds that Ordinance No. 295-74, Chapter 1, § 3, 7 prohibits the City from issuing a business license if the business does not comply with 8 the requirements of the ordinances relating to zoning, building, fire hazards, health and 9 sanitation; and 10 WHEREAS, City Council finds that presently for a business to be assessed 11 business and occupation tax the business must first acquire a City business license; and 12 WHEREAS, City Council finds that there exist businesses which operate within 13 the City limits which are not licensed and are, therefore, not assessed business and 14 occupation tax; and 15 WHEREAS, City Council finds that all businesses operating within the City 16 whether licensed or not shall be responsible for paying business and occupation tax if 17 they otherwise qualify. 18 NOW, THEREFORE, THE CITY OF EVERETT DOES ORDAIN: 19 Section 1: Ordinance No. 295-74, Chapter 1, § 3 (EMC 5.04.030) reads as 20 follows: 21 General requirements for all licenses. 22 The general requirements relating to all licenses in this title are as 23 follows: 24 A. No person shall make false statements in the application; 25 B. No license shall enable any person to engage in any dishonest, unlawful or unfair act, practice or enterprise; 26 C. The applicant must comply with the requirements of the ordinances 27 relating to zoning, building, fire hazards, health and sanitation. 28 Failure to comply with the aforesaid general requirements shall be grounds for denial, suspension or recovcations of any license issued 29 pursuant to this title. 30 Be and the same is hereby amended to read as follows: 31 32
