S$ 3 - <br /> An Ordinance Amending the zoning map <br /> of the City of Everett as provided by <br /> Municipal Code Title 19 (Ordinance No. 3572) <br /> Rezone #7-82 Casino Road Enterprises <br /> 150' west of Evergreen Way on Casino Road <br /> WHEREAS, on July 1, 1982, the Land Use Hearing Examiner of the City of <br /> Everett held a public hearing regarding rezoning of the hereinafter described <br /> property from R-3, Multiple-Family Low-Density Residential to C-1, General <br /> Commercial zone, and <br /> WHEREAS, the City Council of Everett, after hearing recommendations of <br /> the Land Use Hearing Examiner, has determined that said property should be <br /> rezoned and zoned C-1, General Commercial. <br /> NOW, THEREFORE, the City of Everett does ordain: <br /> Section 1: That the City Council of Everett does hereby find that the zoning <br /> change hereinafter set forth is in the best interest of the City of <br /> Everett and meets the purpose of the Comprehensive Plan. <br /> Section 2: That the proposed zoning change is based on the property owners <br /> executing the attached concomitant agreement to the rezone. <br /> Section 3: That the Zoning Map of the City of Everett, as established by <br /> Everett Municipal Code, Title 19 (Ord. No. 3572, Sec. 4, as <br /> amended) is hereby amended from R-3, Multiple-Family Low <br /> Density Residential to C-1, General Commercial for the following <br /> described property: <br /> PARCEL 1 <br /> That portion of the southeast quarter of the southeast <br /> quarter of Section 12, Township 28 North, Range 4 East, <br /> W.M., described as follows: <br /> Commencing at the southeast corner of said Section 12; <br /> thence north along east line of said section for 30 feet to <br /> the north boundary line of Beverly Park-Mukilteo Highway; <br /> thence west along north boundary line of said highway <br /> 332.10 feet to the true point of beginning; thence north <br /> parallel to east line of Section, 1291.45 feet, more or less, <br /> to north line of the southeast quarter of the southeast <br /> quarter of said section; thence west along the north line of <br /> said southeast quarter of the southeast quarter 166.05 feet; <br /> thence south and parallel to east line of Section, 1291.45 <br /> feet, more or less, to the north boundary line of Beverly <br /> Park-Mukilteo Highway; thence east along north boundary of <br /> said Highway 166.05 feet to the true point of beginning; <br /> Except that portion conveyed to the State of Washington by <br /> deeds recorded under Auditor's File Nos. 2010766 and <br /> 2014278 for State Highway "SR 526"; <br /> Also, except that portion lying northerly of State Highway <br /> "SR 526". <br />
