• <br /> 1 D. The owner of the land on which the automobile hulk is located may appear <br /> 2 in person at the hearing or present a written statement in time for consideration at the <br /> 3 hearing, and deny responsibility for the presence of the hulk on the land, with his <br /> 4 reasons for such denial. If it is determined at the hearing that the hulk was placed on <br /> 5 the land without the consent of the landowner and that he has not subsequently <br /> 6 acquiesced in its presence, then the City Council or hearing examiner shall not assess <br /> 7 costs of administration or removal of the hulk against the property upon which the hulk <br /> 8 is located or otherwise attempt to collect such cost from the property owner. <br /> 9 E. After notice has been given of the intent of the City to dispose of the <br /> 10 automobile hulk and after a hearing, if requested, has been held, resulting in authority <br /> 11 to remove, the automobile hulk or part thereof shall be removed, at the request of a <br /> 12 police officer, and disposed of to a licensed motor vehicle wrecker or hulk hauler with <br /> 13 notice to the Washington State Patrol and the Department that the automobile hulk has <br /> 14 been wrecked. Any automobile hulk impounded pursuant to this section shall be <br /> 15 processed in the manner prescribed by RCW 46.52.111, 46.52.112, 46.52.1194, <br /> 16 46.52.1196 and other pertinent provisions adopted in the Washington Model Traffic <br /> 17 Ordinance, RCW 46.90. <br /> 18 F. The City may, after removal of an automobile hulk from private property, <br /> 19 file for record with the County Auditor to claim a lien for the cost of removal, which <br /> 20 shall be in substance in accordance with the provision covering mechanics' liens in <br /> 21 Chapter 60.04 RCW, and said lien shall be foreclosed in the same manner as such liens. <br /> 22 Section 3: UNLAWFUL TO ABANDON JUNK MOTOR VEHICLES (RCW <br /> 23 48.90.030). No person shall wilfully leave an abandoned junk motor vehicle on private <br /> 24 property for more than twenty-four hours without the permission of the person having <br /> 25 the right to possession of the property, or upon or within the right-of-way of any <br /> 26 highway or other property open to the public for purposes of vehicular travel or parking <br /> 27 for twenty-four hours or longer without notification to the Chief of Police of the <br /> 28 reasons for leaving the motor vehicle in such a place. For the purposes of this section, <br /> 29 the fact that a motor vehicle has been so left without permission or notification is <br /> 30 prima facie evidence of abandonment. Any person convicted of abandoning a junk <br /> 31 motor vehicle shall be assessed any costs incurred by the City in disposing of such <br /> 32 <br /> -4- <br />
