• 1 ORDINANCE NO. 8� ? $02+ 2 AN ORDINANCE amending Ordinance No. 861-82 establishing an 3 additional sales and use tax in the City of Everett independent of whether or not Snohomish County imposes the sales and use tax 4 authorized under Engrossed Senate Bill No. 4972, 1982 First Special Session. 5 6 7 WHEREAS, City Council finds that the City of Everett presently imposes sales 8 and use tax in the amount of one-half of one percent of which Snohomish County 9 receives fifteen percent thereof under Ordinance No. 79-70; and 10 WHEREAS, recently on May 12, 1982, City Council adopted Ordinance No. 11 861-82 imposing an additional one-half of one percent pursuant to Engrossed Senate Bill 12 No. 4972 of the Laws of the State of Washington, 1982 First Special Session, 47th 13 Legislature, which authorized cities to impose an additional sales and use tax up to 14 five-tenths of one percent of the selling price or value of the article used; and 15 WHEREAS, City Council now finds that due to unanticipated revenue require- 16 ments, it is necessary to amend Section 2 of Ordinance No. 861-82 so that the 17 additional tax shall be collected by the City regardless of whether Snohomish County 18 imposes the additional tax; 19 NOW, THEREFORE, THE CITY OF EVERETT DOES ORDAIN: 20 Section 1: Section 2 of Ordinance No. 861-82 which reads as follows: 21 "The additional tax imposed by this ordinance shall be collected on and 22 after July 1, 1982, provided that it is the intent of City Council to impose and collect the additional tax only so long as the additional tax is imposed 23 and collected by Snohomish County, and in the event a referendum on the recent Snohomish County sales tax increase of one-half of one percent 24 stays the County's authorization to impose and collect the additional tax then the City shall stay imposition and collection of the additional tax for 25 the period that Snohomish County is stayed and if it is finally determined by vote of the electorate that Snohomish County is no longer authorized 26 to impose or collect any additional sales tax, then the additional tax imposed herein by the City shall be repealed consistent with the date 27 Snohomish County is no longer authorized to impose or collect the additional tax." 28 29 is hereby amended to read hereafter as follows: 30 "The additional tax imposed by this ordinance shall be collected on and 31 after July 1, 1982." 32
