1 ORDINANCE NO. f�6S=8cz, <br /> 2 <br /> AN ORDINANCE amending Ordinance No. 494-78 in prescribing an <br /> 3 increase in fees relating to false alarms. <br /> 4 <br /> 5 <br /> 6 WHEREAS, there has been an increase in false alarms relating to burglaries <br /> 7 and/or robberies to which the Everett Police Department must respond on an <br /> 8 emergency basis; and <br /> 9 WHEREAS, there is a substantial cost involved in responding to said alarms; <br /> 10 NOW, THEREFORE, THE CITY OF EVERETT DOES ORDAIN: <br /> 11 Section 1: Section 3 of Ordinance No. 494-78 which reads as follows: <br /> 12 <br /> A. For the purposes of this section, the term "false alarm" shall mean <br /> 13 the activation of a burglary and/or robbery alarm by other than <br /> forced entry or attempted forced entry to the premises at a time <br /> 14 when no burglary or robbery is being committed or attempted on <br /> the premises. <br /> 15 <br /> B. For a police response to any false alarm, the Chief of Police shall <br /> 16 charge and collect from the person having or maintaining such <br /> burglary and/or robbery alarm on premises owned or occupied by <br /> 17 him, fees as follows: <br /> 18 1. For a repsonse to premises at which no other false alarm has <br /> occurred within the preceding six (6) month period, herein- <br /> 19 after referred to as a "first response," no fee shall be <br /> charged, but the person having or maintaining such burglary <br /> 20 and/or robbery alarm, shall within three (3) working days <br /> after notice to do so, make a written report to the Chief of <br /> 21 Police, or his designee, on forms prescribed by him, setting <br /> forth the cause of such false alarm, the corrective action <br /> 22 taken, whether such alarm has been inspected by an <br /> authorized serviceman, and such other information as the <br /> 23 Chief of Police or his designee may reasonably require to <br /> determine the cause of such false alarm and corrective <br /> 24 action necessary. <br /> 25 2. For the second response to premises within six (6) months <br /> after a first response, no fee shall be charged, but a written <br /> 26 report shall be required as for a first response and the Chief <br /> of Police or his designee shall be authorized to inspect or <br /> 27 cause to be inspected the alarm system at such premises, <br /> prescribe necessary corrective action, and shall give notice <br /> 28 to the person having or maintaining such alarm system of <br /> the conditions and requirements of this section. <br /> 29 3. For a third response to premises within six months of the <br /> 30 last response, a fee of Twenty-Five Dollars ($25) shall be <br /> charged, and if such third false alarm or any such <br /> 31 succeeding false alarm is as a result of failure to take <br /> necessary corrective action prescribed by the Chief of <br /> 32 <br />
