• <br /> • <br /> • <br /> • . <br /> 1 <br /> 2 <br /> 3 ORDINANCE NO. <br /> 4 <br /> AN ORDINANCE establishing a method of operation for the Everpark <br /> 5 Garage. <br /> 6 <br /> 7 WHEREAS, RCW 35.86.040 authorizes cities to establish by ordinance the <br /> 8 method of operation of off-street parking; and <br /> 9 WHEREAS, City Council has decided for purposes of the Everpark Garage that it <br /> 10 will not establish a parking commission, nor operate off-street parking with City staff; <br /> 11 and <br /> 12 WHEREAS, City Council has decided that Everpark Garage shall be operated <br /> 13 through a management agreement with a private operator, or through a lease <br /> 14 agreement; and <br /> 15 WHEREAS, the Everpark Garage is an off-street parking facility open to the <br /> 16 general public to serve civic center purposes; and <br /> 17 WHEREAS, City Council finds that it is not necessary to follow formal bid <br /> 18 procedures in selecting a private operator for a management agreement; <br /> 19 NOW, THEREFORE, THE CITY OF EVERETT DOES ORDAIN: <br /> 20 Section 1: The Everpark Garage shall be operated by a private operator <br /> 21 through a management agreement or through a lease agreement executed with the City. <br /> 22 Section 2: The management agreement and the lease shall be for a term not <br /> 23 to exceed three (3) years. <br /> 24 Section 3: The City shall seek proposals from private operators. If no <br /> 25 proposal is received for the operation of Everpark Garage, or if the proposals received <br /> 26 are not satisfactory, the City may negotiate with a private operator for the operation <br /> 27 of the facility. <br /> 28 Section 4: The City Council Finance and Budget Committee shall develop <br /> 29 procedures to be followed in obtaining and reviewing the proposals. Once the proposals <br /> 30 have been reviewed, those deemed most satisfactory shall be presented to City Council <br /> 31 <br /> 32 <br />
