1 <br /> Phase I shall consist of: <br /> A. The vacation of that portion of Upper Ridge Road lying south of <br /> Glenwood Avenue and north of the proposed intersection of the <br /> realignment, with the existing Upper Ridge Road (see exhibit "A"). <br /> B. The realignment of the northern portion of Upper Ridge Road to <br /> provide an improved intersection with Glenwood Avenue. Said <br /> realignment shall be in accordance with applicable CITY standards <br /> and the attached Exhibit "B". <br /> C. The reconstruction of that portion of the existing Upper Ridge <br /> Road that is to be removed and mined by ASSOCIATED lying <br /> north of the Boeing Haul Road and south of the proposed Phase I <br /> intersection. This replacement section shall be constructed in <br /> accordance with applicable CITY standards and the attached <br /> Exhibit "C". <br /> 5. The CITY agrees to reimburse ASSOCIATED for the engineering design <br /> services for the Upper Ridge Road realignment and reconstruction of <br /> the nonvacated portion of Upper Ridge Road up to a maximum amount <br /> of $12,000. <br /> 6. ASSOCIATED agrees to perform the Phase I construction and any <br /> required utility relocations at no cost to the CITY. Construction shall <br /> commence upon acquisition of all necessary right-of-way and shall be <br /> completed within one year of date on which either excavation of Upper <br /> Ridge Road begins or public use of this portion of Upper Ridge Road is <br /> terminated, whichever is sooner. Should it become necessary, a time <br /> extension may be granted by the CITY. Such an extension shall be <br /> contingent upon an evaluation of ASSOCIATED's efforts to complete <br /> the project within the prescribed one year period.
