S I . <br /> 10. Should ASSOCIATED choose to develop its property prior to the CITY <br /> desiring to acquire the Phase II corridor, this agreement shall not <br /> negate the CITY'S right to require ASSOCIATED to deed land and <br /> construct roads per applicable CITY ordinances. <br /> 11. Upon completion of the Phase I construction and until such time as the <br /> Phase II link is constructed, ASSOCIATED agrees to grant the CITY the <br /> right to interim public use of the Boeing Haul Road between Hardeson <br /> Road and Upper Ridge Road (see exhibit "A"). The CITY will be <br /> • responsible for improvements, maintenance and traffic control which <br /> may be necessary during the public use period and, further, the CITY <br /> shall hold harmless ASSOCIATED from any liability for losses or <br /> damages arising from the temporary public use of the Boeing Haul <br /> Road. Provided that, the grant herein provided shall be permissive by <br /> ASSOCIATED and individuals and the public at large will not be <br /> deemed to have acquired any prescriptive or adverse possession rights <br /> by use in connection with the use of said roadway. <br /> -5- <br />
