• ORDINANCE NO. g3y-,,,2 AN ORDINANCE providing for the improvement of: Everett Mall Way S. E. (formerly South Broadway) at its intersection with Primary State Highway No. 1 (SR 5) (Inter- state 5) southbound off-ramp by the construction and installation of a traffic signal system and creating a Local Improvement District Fund therefor: And providing for the payment of said improvement by special assessments on the property in said District under the mode of payment by bonds or installment notes. WHEREAS, the City Council has accepted a majority petition and declared its intention to order the improvement as outlined hereafter and doing all work in connection therewith to make a complete improvement in accordance with the plans and specifications of the City Engineer of the City of Everett; and WHEREAS, the City Council held a hearing on January 27, 1982, after due public notice; NOW, THEREFORE, THE CITY OF EVERETT DOES ORDAIN: Section 1: That the City Council of the City of Everett finds and declares that the improvement hereinafter described is in the public interest and hereby directs its construction. Section 2: That an improvement be made of: Everett Mall Way S.E. (formerly South Broadway) at its intersection with Primary State Highway No. 1 (SR 5) (Interstate 5) southbound off-ramp by the construction and installation of a traffic signal system, appurtenances, and work necessary for a complete signal improvement. The City may make such changes as determined appropriate in the above locations and sizes of improvements so long as the purpose and intent of the service is not altered. All of the aforesaid improvements shall be in accordance with plans to be prepared by the City Engineer, which plans and specifications are hereby adopted and approved. Section 3: That the cost and expenses of the improvement, including but not limited to, all necessary and incidental expenses or fees or property acquisition costs, shall be borne by and assessed against the property included in the assessment district herein created. The costs and the expenses of the improvement to be assessed against the property, including the assessment district herein created, shall be assessed in accordance with the special benefits derived from the improvement and without regard to the zone and termini method of spreading assessments. The City shall not be liable in any manner for any of the remaining expense and costs of the improvement except that Washington State Department of Transportation shall provide the traffic signal controller and the City of Everett Half Cent Gas Tax Fund Number 301 shall contribute one-half of the remaining cost and except as provided in Chapter 144, Session Laws of 1923 or acts amendatory thereto, and the ordinances of the City of Everett.
