• <br /> ORDINANCE NO. g3y-,,,2 <br /> AN ORDINANCE providing for the improvement of: <br /> Everett Mall Way S. E. (formerly South Broadway) at its <br /> intersection with Primary State Highway No. 1 (SR 5) (Inter- <br /> state 5) southbound off-ramp by the construction and installation <br /> of a traffic signal system and creating a Local Improvement <br /> District Fund therefor: And providing for the payment of said <br /> improvement by special assessments on the property in said <br /> District under the mode of payment by bonds or installment notes. <br /> WHEREAS, the City Council has accepted a majority petition and declared its <br /> intention to order the improvement as outlined hereafter and doing all work in <br /> connection therewith to make a complete improvement in accordance with the plans <br /> and specifications of the City Engineer of the City of Everett; and <br /> WHEREAS, the City Council held a hearing on January 27, 1982, after due <br /> public notice; <br /> NOW, THEREFORE, THE CITY OF EVERETT DOES ORDAIN: <br /> Section 1: That the City Council of the City of Everett finds and declares that <br /> the improvement hereinafter described is in the public interest and hereby directs its <br /> construction. <br /> Section 2: That an improvement be made of: <br /> Everett Mall Way S.E. (formerly South Broadway) at its intersection with Primary <br /> State Highway No. 1 (SR 5) (Interstate 5) southbound off-ramp by the construction <br /> and installation of a traffic signal system, appurtenances, and work necessary for a <br /> complete signal improvement. The City may make such changes as determined <br /> appropriate in the above locations and sizes of improvements so long as the purpose <br /> and intent of the service is not altered. All of the aforesaid improvements shall be in <br /> accordance with plans to be prepared by the City Engineer, which plans and <br /> specifications are hereby adopted and approved. <br /> Section 3: That the cost and expenses of the improvement, including but not <br /> limited to, all necessary and incidental expenses or fees or property acquisition costs, <br /> shall be borne by and assessed against the property included in the assessment district <br /> herein created. The costs and the expenses of the improvement to be assessed <br /> against the property, including the assessment district herein created, shall be <br /> assessed in accordance with the special benefits derived from the improvement and <br /> without regard to the zone and termini method of spreading assessments. The City <br /> shall not be liable in any manner for any of the remaining expense and costs of the <br /> improvement except that Washington State Department of Transportation shall <br /> provide the traffic signal controller and the City of Everett Half Cent Gas Tax Fund <br /> Number 301 shall contribute one-half of the remaining cost and except as provided in <br /> Chapter 144, Session Laws of 1923 or acts amendatory thereto, and the ordinances of <br /> the City of Everett. <br />
