herein are minimum coverage and limit of liability requirements only. They shall not be <br /> construed to limit the liability of C2C or any insurer for any claim that is required to be <br /> covered hereunder. Moreover,the City shall be an additional insured,where additional <br /> insured status is required, for the full available limits of liability maintained by C2C, <br /> whether those limits are primary,excess,contingent or otherwise. <br /> Section 12. NON-INTERFERENCE WITH CITY USE. C2C use of the Property <br /> shall not interfere in any way with any City use of the Property, including utilities and <br /> travel. <br /> Section 13. Intentionally Omitted. <br /> Section 14. REPAIR OF PROPERTY. C2C shall use care to avoid damaging or <br /> destroying City property by reason of its use pursuant to this License. Any damage <br /> caused by C2C to City or other property shall be promptly repaired or replaced by C2C to <br /> the satisfaction of the City,or in lieu of such repair or replacement,C2C shall pay,to the <br /> City or owner of the other property,money in an amount sufficient to compensate for the <br /> loss sustained by reason of damage to or destruction of the City's or other party's <br /> property. <br /> Section 15. RISK OF LOSS TO GRANTEE'S PROPERTY. C2C bears all risk of <br /> any and all damage and loss to personal property located on the'property associated with <br /> this License and C2C's use of the Property. <br /> Section 16. Intentionally Omitted. <br /> Section 17. NO WARRANTY. The City does not warrant its title or ownership of the <br /> Property. <br /> Section 18. NON-EXCLUSIVE. This License is not exclusive. The City is not <br /> prohibited from granting permission to others to occupy or use portions of the Property <br /> where such uses are not inconsistent with this License. <br /> Section 19. RESERVATION OF RIGHTS. The City reserves all rights not <br /> expressly granted by this License. <br /> Section 20. NO THIRD PARTY RIGHTS. This License does not create any rights <br /> in any third party. <br /> Section 21. APPLICABLE LAW AND VENUE. The laws of the State of <br /> Washington shall apply to this License. Venue for any lawsuit arising out of or related to <br /> this License shall be in Snohomish County Superior Court, Washington. <br /> page 3 <br />
