CITY CONTRACT THIS CONTRACT is made and entered into this /✓ day of /L2� 2018, by and between the City of Everett, Washington, a municipal corporation a isting under the laws of the State of Washington, hereinafter called the "City," and Alpine Waterproofing and Masonry Restoration, LLC, hereinafter called the "Contractor." In consideration of the sums to be paid to it by the City, Contractor hereby covenants and agrees to furnish all labor, tools, materials, equipment, and supplies required to build and construct and to build and construct in a workmanlike manner the Work, improvements, and appurtenances in accordance with the Façade Water Investigation documents, Specifications,and the project details, photos and drawings, Appendix 1 Repair Locations, Appendix 2 Repair Details, Appendix 3 Construction Record Drawings, Appendix 4 Storefront Shop Drawings: "Everett Station Water Intrusion Repairs and Brick Restoration", (the "Project"). 1. Contract Documents. The following documents ("Contract Documents") are incorpo- rated by reference and are hereby made a part of this Contract: A. Notice to Bidders B. Instructions to Bidders C. General Conditions D. Supplementary Conditions (if any) E. Drawings, Standard Plans, and Specifications F. Addenda(if any) G. Payment and Performance Bond H. Contractor's Bid Form I. Other documents described as Contract Documents in Section 072000, General Conditions J. All provisions required by law whether set forth and reproduced herein or not Terms that are capitalized in a Contract Document but not defined in that Contract Document shall have the meaning defined to them in the other Contract Documents. 2. Contract Time. Substantial Completion of the Work shall be achieved within ninety(90) calendar days after the effective date of the Notice to Proceed. Physical Completion shall be within calendar(30) calendar days after the actual date of issuance of substantial completion and shall not be later than October 15,2018. 3. Liquidated Damages (NOT USED) 4. Contract Sum. The amount of this Contract is ($739,800.00)not including Washington State sales tax, which will be paid when invoiced and is based on the bid submitted by Contractor dated May 15, 2018.
