Y/ -2/ 2 AN ORDINANCE amending Ordinance 517-78, Short Plat and Short 3 Subdivision Ordinance, redefining the Applicability Section, Section 010; redefining the Exemption Section, Section 020; re- 4 defining the Appeal Section, Section 230; adding a new section defining boundary line adjustment procedure; and adding other new 5 sections. 6 7 WHEREAS, City Council desires to preclude the circumvention of the subdivision 8 code through multiple short platting; and 9 WHEREAS, City Council desires to provide a process for boundary line adjust- 10 ments; and 11 WHEREAS, City Council finds that the existing Short Subdivision Code needs 12 updating; and 13 WHEREAS, City Council finds that the Short Plat and Short Subdivision Code is 14 enacted as protection for the general public and not to create a duty to or in favor of 15 persons individually; and 16 WHEREAS, the Planning Commission recommends its adoption. 17 NOW, THEREFORE, THE CITY OF EVERETT DOES ORDAIN: 18 Section 1: Ordinance No. 517-78, Section 010, which now reads as follows: 19 Section 010: Applicability 20 Every division of land for the purpose of lease, sale, or development into 21 two (2) or more but less than five (5) lots within the City of Everett shall proceed in compliance with the provisions of the State laws and this title. 22 23 be and the same is hereby amended to read as follows: 24 Section 010: Applicability 25 1. Every division or redivision of land into four or fewer lots, tracts, 26 parcels, sites or divisions for the purpose of sale, lease or transfer of ownership shall proceed in compliance with the provisions of the 27 State laws and this title. 28 2. For purposes of determining the total number of lots, tracts, parcels or sites involved in a proposed short subdivision, all 29 property which is contiguous to the proposed short subdivision shall be included in the calculation of total number of lots, tracts, 30 parcels or sites. 31 32
