Y/ -2/ <br /> 2 <br /> AN ORDINANCE amending Ordinance 517-78, Short Plat and Short <br /> 3 Subdivision Ordinance, redefining the Applicability Section, <br /> Section 010; redefining the Exemption Section, Section 020; re- <br /> 4 defining the Appeal Section, Section 230; adding a new section <br /> defining boundary line adjustment procedure; and adding other new <br /> 5 sections. <br /> 6 <br /> 7 WHEREAS, City Council desires to preclude the circumvention of the subdivision <br /> 8 code through multiple short platting; and <br /> 9 WHEREAS, City Council desires to provide a process for boundary line adjust- <br /> 10 ments; and <br /> 11 WHEREAS, City Council finds that the existing Short Subdivision Code needs <br /> 12 updating; and <br /> 13 WHEREAS, City Council finds that the Short Plat and Short Subdivision Code is <br /> 14 enacted as protection for the general public and not to create a duty to or in favor of <br /> 15 persons individually; and <br /> 16 WHEREAS, the Planning Commission recommends its adoption. <br /> 17 NOW, THEREFORE, THE CITY OF EVERETT DOES ORDAIN: <br /> 18 Section 1: Ordinance No. 517-78, Section 010, which now reads as follows: <br /> 19 <br /> Section 010: Applicability <br /> 20 <br /> Every division of land for the purpose of lease, sale, or development into <br /> 21 two (2) or more but less than five (5) lots within the City of Everett shall <br /> proceed in compliance with the provisions of the State laws and this title. <br /> 22 <br /> 23 be and the same is hereby amended to read as follows: <br /> 24 <br /> Section 010: Applicability <br /> 25 <br /> 1. Every division or redivision of land into four or fewer lots, tracts, <br /> 26 parcels, sites or divisions for the purpose of sale, lease or transfer <br /> of ownership shall proceed in compliance with the provisions of the <br /> 27 State laws and this title. <br /> 28 2. For purposes of determining the total number of lots, tracts, <br /> parcels or sites involved in a proposed short subdivision, all <br /> 29 property which is contiguous to the proposed short subdivision shall <br /> be included in the calculation of total number of lots, tracts, <br /> 30 parcels or sites. <br /> 31 <br /> 32 <br />
