• <br /> • <br /> 1 (a) Upon every person engaged in or carrying on a telegraph <br /> business, a fee of $100.00 per year, or tax equal to five (5%) percent of <br /> 2 the total gross income from such business in the city during the fiscal <br /> year next preceding the tax year for which the license is required, <br /> 3 whichever is the greater. <br /> 4 (b) Upon every person engaged in or carrying on a telephone <br /> business, a fee or tax equal to six (6%) percent of the total gross <br /> 5 operating revenues, including revenues from intrastate toll, derived from <br /> the operation of such businesses within the City of Everett, during the <br /> 6 current calendar year for which the license is required, which shall be <br /> paid monthly on or before the 20th day of the following month. <br /> 7 <br /> 1. Gross operating revenues for this purpose <br /> 8 shall not include charges which are passed on to the <br /> subscribers by a telephone company pursuant to tariffs <br /> 9 required by regulatory order to compensate for the cost <br /> to the company of the tax imposed by this ordinance. <br /> 10 <br /> 2. "Telephone Business" means the business of <br /> 11 providing access to a local telephone network, local <br /> telephone network switching service, toll service, or coin <br /> 12 telephone services, or providing telephonic, video, data, <br /> or similar communication or transmission for hire, via a <br /> 13 local telephone network, toll line or channel, or similar <br /> communication or transmission system. It includes co- <br /> 14 operative or farmer line telephone companies or associa- <br /> tions operating an exchange. "Telephone business" does <br /> 15 not include the providing of competitive telephone <br /> service, nor the providing of cable television service. <br /> 16 <br /> 3. "Competitive telephone service" means the <br /> 17 providing by any person of telephone equipment, <br /> apparatus, or service, other than toll service, which is of <br /> 18 a type which can be provided by persons that are not <br /> subject to regulation as telephone companies under Title <br /> 19 80 RCW and for which a separate charge is made. <br /> 20 (c) Upon every person engaged within the City of Everett in the <br /> sale of artificial, natural or mixed gasses, a fee or tax equal to three (3%) <br /> 21 percent of the first $5,000.00 per month of revenue derived from each <br /> customer consuming gas in the City of Everett and one (1%) percent on all <br /> 22 additional revenues per month derived from each customer consuming gas <br /> in the City of Everett. All fees or taxes shall be paid monthly on or <br /> 23 before the 20th day of the following month. The definition of a customer <br /> is any person, firm or corporation purchasing gas from a company at a <br /> 24 single location. <br /> 25 <br /> Section 2: This Ordinance shall take effect on January 1, 1982, and the <br /> 26 <br /> occupational taxes and license fees and the respective increases of the occupational <br /> 27 <br /> taxes and license fees provided in this ordinance shall be effective and applicable from <br /> 28 <br /> and after January 1, 1982. <br /> 29 <br /> 30 <br /> 31 <br /> 32 -2- <br />
