• • 1 (a) Upon every person engaged in or carrying on a telegraph business, a fee of $100.00 per year, or tax equal to five (5%) percent of 2 the total gross income from such business in the city during the fiscal year next preceding the tax year for which the license is required, 3 whichever is the greater. 4 (b) Upon every person engaged in or carrying on a telephone business, a fee or tax equal to six (6%) percent of the total gross 5 operating revenues, including revenues from intrastate toll, derived from the operation of such businesses within the City of Everett, during the 6 current calendar year for which the license is required, which shall be paid monthly on or before the 20th day of the following month. 7 1. Gross operating revenues for this purpose 8 shall not include charges which are passed on to the subscribers by a telephone company pursuant to tariffs 9 required by regulatory order to compensate for the cost to the company of the tax imposed by this ordinance. 10 2. "Telephone Business" means the business of 11 providing access to a local telephone network, local telephone network switching service, toll service, or coin 12 telephone services, or providing telephonic, video, data, or similar communication or transmission for hire, via a 13 local telephone network, toll line or channel, or similar communication or transmission system. It includes co- 14 operative or farmer line telephone companies or associa- tions operating an exchange. "Telephone business" does 15 not include the providing of competitive telephone service, nor the providing of cable television service. 16 3. "Competitive telephone service" means the 17 providing by any person of telephone equipment, apparatus, or service, other than toll service, which is of 18 a type which can be provided by persons that are not subject to regulation as telephone companies under Title 19 80 RCW and for which a separate charge is made. 20 (c) Upon every person engaged within the City of Everett in the sale of artificial, natural or mixed gasses, a fee or tax equal to three (3%) 21 percent of the first $5,000.00 per month of revenue derived from each customer consuming gas in the City of Everett and one (1%) percent on all 22 additional revenues per month derived from each customer consuming gas in the City of Everett. All fees or taxes shall be paid monthly on or 23 before the 20th day of the following month. The definition of a customer is any person, firm or corporation purchasing gas from a company at a 24 single location. 25 Section 2: This Ordinance shall take effect on January 1, 1982, and the 26 occupational taxes and license fees and the respective increases of the occupational 27 taxes and license fees provided in this ordinance shall be effective and applicable from 28 and after January 1, 1982. 29 30 31 32 -2-
