r <br /> a. <br /> ORDINANCE NO. gO , / <br /> An Ordinance amending the zoning <br /> map of the City of Everett as provided <br /> by Everett Municipal Code, Title 19 <br /> (Ordinance No. 3572 as amended) <br /> CASINO RIDGE PRD <br /> WHEREAS, on August 20, 1981, the City of Everett Land Use Hearing Examiner <br /> held a public hearing regarding rezoning of the hereinafter described property from <br /> R-3, Multiple-Family Low-Density Residential to R-3 Planned Residential <br /> Development, and <br /> WHEREAS, the City Council of Everett, after hearing the recommendations of • <br /> the Hearing Examiner has determined that said property should be rezoned and zoned <br /> R-3 Planned Residential Development (per Ord. No. 414-76, Sec. 70), <br /> NOW, THEREFORE, the City of Everett does ordain <br /> Section 1: That the City Council of the City of Everett does hereby find that <br /> the PRD zoning change hereinafter set forth is in the best interest of the City of <br /> ' Everett, and meets the purpose and requirements of the Planned Residential <br /> Development Ordinance No. 414-76 and the Comprehensive Plan. <br /> Section 2: That the proposed zoning is based on the applicant meeting the <br /> conditions stated in the attached development contract, and developing the rezoned <br /> area per the project site plan. • <br /> Section 3: That the Zoning Map of the City of Everett, as established by <br /> Everett Municipal Code, Title 19 (Ord. No. 3572, Sec. 4 as amended) is hereby <br /> amended from R-3, Multiple-Family Low-Density Residential to R-3, Planned <br /> Residential Development for the following described property: <br /> All that part of the following described Tract 'X' lying southerly of a line <br /> described as follows: Beginning at a point that bears S 1°39'00" W 185 ft. from <br /> Highway Engineer's Station 170+50 on the centerline survey of SR 526 MP 0.92 <br /> to MP 4.41 Everett; 40th Ave. W. to SR 5; thence northeasterly 265 ft. more or <br /> less, to a point that bears S 1°39'00" W 95 ft. from the end of this line <br /> description. Tract 'X': Tracts 25 and 26 of Beverly Homesites, Division No. 1, <br /> as shown upon the plat thereof filed for record in the office of the County <br /> Auditor in and for Snohomish County, Washington; EXCEPT the South 35 ft. of <br /> said Tract 25; also except the following parcel of land in said Tract 26: <br /> Beginning at a point 20 ft. North of the Southwest corner of said Tract 26; <br /> thence South 20 feet; thence East 40 ft; thence Northwesterly 45 ft., more or <br /> less, to the Point of Beginning; situated in the County of Snohomish, State of <br /> Washington. (Portion of SE% Sec. 12, T. 28, R.4 E.W.M.) <br /> Section 4: That the official zoning maps in the Building and Planning <br /> Department shall upon the passage of this Ordinance be amended, as hereinabove <br /> provided, and henceforth said property shall be used in accordance with development <br /> requirements stated in the attached contract. <br />
