Concomitant Agreement to Rezone Ordinance No. 802-81 <br /> This Agreement, made and entered into this 8th day of October, 1981, by and between <br /> the City of Everett, a municipal corporation, hereinafter called the City, and R.B. <br /> Bolding and R.E. Bolding, DBA Bold Lease Co., hereinafter called the Owner, <br /> WITNESSETH; <br /> WHEREAS the Owner has made application to the City for a change in the <br /> zoning classification of the following described parcel: <br /> Lot 6, Block 608, Plat of Everett, in Sec. 20, T. 29, <br /> R5 E.W.M. <br /> WHEREAS, such rezoning and development to the new zone standards would <br /> create a situation where business and commercial use would abut a residential zone; <br /> and the public health, safety and welfare would be best served by anticipating the <br /> impact of such development and imposing certain mutually agreed upon standards, <br /> conditions and requirements; <br /> NOW, THEREFORE, IT IS MUTUALLY AGREED AS FOLLOWS: <br /> 1. That the site development be in conformance with the site plan submitted as <br /> modified by the Planning Department's Staff Report. <br /> 2. That the Applicant conform and follow any variances and conditions to the <br /> variance that may be given for the subject property. <br /> 3. That on-site detention must be provided in accordance with the City Drainage <br /> Ordinance. <br /> 4. That the building height be limited to 19 feet. <br /> 5. That the Applicant shall submit to the Public Works Department a plan showing <br /> parking layout, landscaping, driveways, utilities, storm drainage, and all <br /> required improvements to the public right-of-way. Public Works Department <br /> approval of these drawings is required before any permits are issued. All <br /> improvements shall be completed before the Occupancy Permit is issued. <br /> Further, the Applicant shall consider all variances that may be granted in <br /> submitting his plans to the Public Works Department. <br /> 6. That the City streets are to be kept clear of dirt and debris during construction. <br /> 7. That during construction, all truck traffic to and from the site within the City <br /> of Everett shall be on arterial streets unless otherwise approved by the Public <br /> Works Department. <br /> 8. That the Applicant shall pay a capital improvement sewer connection fee. The <br /> cost shall be computed by the Building Department per the ordinance in effect <br /> at the time of Building Permit issuance. <br /> 9. That the landscaping on Lombard Avenue be as established by the final <br /> determination on the variance request of the Applicant. The Applicant shall <br /> provide the Planning Department with final landscaping plans at that time. The <br /> Planning Staff shall review and may approve these plans. These plans shall show <br /> planting type, number of plants, general location, and plant size at the time of <br /> planting. <br /> 10. A 120% bond or other acceptable financial commitment shall be filed with the <br /> City prior to Rezone Ordinance No. 802-81 being filed with the County to insure <br /> that is carried out. The bond or money shall not be released until one year from <br /> the issuance of building permits for the proposed new service shop, to insure <br /> that the landscaping is properly maintained and that any dead loss that occurs in <br /> that one year period is replaced. <br />
