f <br /> XIF <br /> t � <br /> 1 ORDINANCE NO. -7' 7 <br /> 2 <br /> AN ORDINANCE providing for the vacation of Wilmington Avenue lying <br /> 3 between 48th Street and Evergreen Way. <br /> 4 <br /> 5 <br /> WHEREAS, the City Council of the City of Everett did by Resolution No. 1922 <br /> 6 <br /> duly adopt and fix the 15th day of April, 1981, at 7:00 p.m. as the date for public <br /> 7 <br /> hearing; and <br /> 8 <br /> WHEREAS, due and legal notice of the time and place of said hearing and <br /> 9 <br /> determination of said resolution has been given by the City Clerk in the manner <br /> 10 <br /> prescribed by law; and <br /> 11 <br /> WHEREAS, at the time and place fixed for hearing favorable statements and <br /> 12 <br /> objections to the vacating of the herein described street were heard and discussed; and <br /> 13 <br /> WHEREAS, on September 23, 1980, the Transportation Advisory Committee <br /> 14 <br /> recommended the vacation of Wilmington Avenue conditioned upon: 1) a perpetual <br /> 15 <br /> covenant to provide unobstructed vehicle and pedestrian access (two 12 foot travel <br /> 16 <br /> lanes and a six foot pedestrian walkway) over and across the south 30 feet of <br /> 17 <br /> Wilmington Avenue; and 2) covenant their heirs, successors, and assigns are solely <br /> 18 responsible and liable for the maintenance and reconstruction of the above-mentioned <br /> 19 travelway; and <br /> 20 WHEREAS, it now appears to the City Council of the City of Everett that the <br /> 21 said street resolved to be vacated should be vacated; <br /> 22 NOW, THEREFORE, THE CITY OF EVERETT DOES ORDAIN: <br /> 23 Section 1: All that portion of Wilmington Avenue: <br /> 24 Lying South and West of Block 17, Plat of Central Park Addition, <br /> 25 according to the plat thereof recorded in Volume 4 of Plats, page 2, <br /> records of Snohomish County, Washington; and <br /> 26 Lying North and East of Lot "A," Plat of South Highway Addition to <br /> 27 Everett, according to the plat thereof recorded in Volume 12 of Plats, <br /> page 10, records of Snohomish County, Washington, and vacated <br /> 28 Claremont Way vacated under Ordinance No. 3306, and Lot 1, Plat of <br /> Claremont Heights, according to the plat thereof recorded in Volume 5 of <br /> 29 Plats, page 15, records of Snohomish County, Washington; also <br /> 30 That portion of Lot "A" described as follows: <br /> 31 Beginning at the Southwest corner of Lot "A," South Highway Addition to <br /> Everett; thence N 5 46' E along the West boundary of said Lot "A" for <br /> 32 <br />
