1 establish or designate any particular class or group of persons who will or should be 2 especially protected or benefited by the terms of this Code. 3 It is the specific intent of this Code that no provision nor term used in this Code 4 is intended to impose any duty whatsoever upon the City or any of its officers or 5 employees, for whom the implementation or enforcement of this Code shall be 6 discretionary and not mandatory. 7 Nothing contained in this Code is intended to be nor shall be construed to create 8 or form the basis for any liability on the part of the City, or its officers, employees or 9 agents, for any injury or damage resulting from the failure of a building to comply with 10 the provisions of this Code, or by reason or in consequence of any inspection, notice, 11 order, certificate, permission or approval authorized or issued or done in connection 12 with the implementation or enforcement of this Code, or by reason of any action or 13 inaction on the part of the City related in any manner to the enforcement of this Code 14 by its officers, employees or agents. 15 Section 7: Violations and Penalties. 16 Any person, firm or corporation violating any provision of this Code shall be 17 deemed guilty of a misdemeanor and, upon conviction thereof, shall be punishable by a 18 fine not to exceed $500 or by imprisonment in jail not to exceed 6 months, or both fine 19 and imprisonment. Each separate day or any portion thereof, during which any violation 20 of this Code occurs or continues, shall be deemed to constitute a separate offense and, 21 upon conviction thereof, shall be punishable as herein provided. The issuance or 22 granting of a permit or approval of plans and specifications shall not be deemed or 23 construed to be a permit for, or an approval of, any violation of any of the provisions of 24 this Code. No permit presuming to give authority to violate or cancel the provisions of 25 this Code shall be valid, except insofar as the work or use which it authorized is lawful. 26 The issuance or granting of a permit or approval of plans shall not prevent the 27 Building Official from thereafter requiring the correction of errors in said plans and 28 specifications or from preventing construction operations being carried on thereunder 29 when in violation of this Code or of any other ordinance or from revoking any 30 certificate of approval when issued in error. 31 Every permit issued by the Building Official under the provisions of this Code 32 shall expire by limitation and become null and void, if the work authorized by such -2-
