1 establish or designate any particular class or group of persons who will or should be <br /> 2 especially protected or benefited by the terms of this Code. <br /> 3 It is the specific intent of this Code that no provision nor term used in this Code <br /> 4 is intended to impose any duty whatsoever upon the City or any of its officers or <br /> 5 employees, for whom the implementation or enforcement of this Code shall be <br /> 6 discretionary and not mandatory. <br /> 7 Nothing contained in this Code is intended to be nor shall be construed to create <br /> 8 or form the basis for any liability on the part of the City, or its officers, employees or <br /> 9 agents, for any injury or damage resulting from the failure of a building to comply with <br /> 10 the provisions of this Code, or by reason or in consequence of any inspection, notice, <br /> 11 order, certificate, permission or approval authorized or issued or done in connection <br /> 12 with the implementation or enforcement of this Code, or by reason of any action or <br /> 13 inaction on the part of the City related in any manner to the enforcement of this Code <br /> 14 by its officers, employees or agents. <br /> 15 Section 7: Violations and Penalties. <br /> 16 Any person, firm or corporation violating any provision of this Code shall be <br /> 17 deemed guilty of a misdemeanor and, upon conviction thereof, shall be punishable by a <br /> 18 fine not to exceed $500 or by imprisonment in jail not to exceed 6 months, or both fine <br /> 19 and imprisonment. Each separate day or any portion thereof, during which any violation <br /> 20 of this Code occurs or continues, shall be deemed to constitute a separate offense and, <br /> 21 upon conviction thereof, shall be punishable as herein provided. The issuance or <br /> 22 granting of a permit or approval of plans and specifications shall not be deemed or <br /> 23 construed to be a permit for, or an approval of, any violation of any of the provisions of <br /> 24 this Code. No permit presuming to give authority to violate or cancel the provisions of <br /> 25 this Code shall be valid, except insofar as the work or use which it authorized is lawful. <br /> 26 The issuance or granting of a permit or approval of plans shall not prevent the <br /> 27 Building Official from thereafter requiring the correction of errors in said plans and <br /> 28 specifications or from preventing construction operations being carried on thereunder <br /> 29 when in violation of this Code or of any other ordinance or from revoking any <br /> 30 certificate of approval when issued in error. <br /> 31 Every permit issued by the Building Official under the provisions of this Code <br /> 32 shall expire by limitation and become null and void, if the work authorized by such <br /> -2- <br />
