• <br /> 1 ORDINANCE NO. / 9'-'/ <br /> 2 <br /> AN ORDINANCE regulating the consumption of liquor within specified <br /> 3 buildings, structures and other approved enclosed and restricted <br /> areas of the park facilities of the City of Everett. <br /> 4 <br /> 5 <br /> 6 WHEREAS, Ordinance No. 225-73 provides for the consumption of alcoholic <br /> 7 beverages under limited circumstances; and <br /> 8 WHEREAS, from time to time the City receives requests from special interest <br /> 9 groups for the privilege to hold events in City parks which include the serving of <br /> 10 alcoholic beverages; <br /> 11 NOW, THEREFORE, THE CITY OF EVERETT DOES ORDAIN: <br /> 12 Section 1: That Section 2 of Ordinance No. 225-73, which reads as follows: <br /> 13 <br /> Upon the conditions hereafter specified, it shall be lawful to open a <br /> 14 package containing liquor, to possess or display an open container of <br /> liquor or to consume liquor in those Park and Recreation buildings or <br /> 15 structures of the City of Everett as specified by Resolution of the City <br /> Council. The persons using such premises for the purpose of opening a <br /> 16 package containing liquor, possessing or displaying an open container of <br /> liquor and/or consuming liquor must obtain a Banquet and Rental Permit <br /> 17 from the Superintendent of Park and Recreation of the City of Everett or <br /> his designee at the Park and Recreation Offices. Such Banquet and <br /> 28 Rental Permit shall be issued on the following conditions: <br /> 19 a. The applicant must produce evidence that it has a Banquet Permit <br /> from the Washington State Liquor Control Board. <br /> 20 <br /> b. The applicant deposit a sum of $50.00 to insure proper performance <br /> 21 of clean up by the applicant subsequent to the event for which the <br /> Banquet and Rental permit is issued. <br /> 22 <br /> c. The applicant must affirm in writing that the attendance at the <br /> 23 function for which the Banquet and Rental Permit is issued is not <br /> pursuant to a general invitation to the public but pursuant to <br /> 24 invitations either to specifically named persons or to actual <br /> members of the applicant's organization. <br /> 25 <br /> d. The applicant agrees that he or she will save the City of Everett <br /> 26 harmless from all losses or damages occasioned to him or her or to <br /> any third person or property by reason of any acts or omissions of <br /> 27 the applicant or anyone using the premises pursuant to the Banquet <br /> and Rental permit, and he or she shall, after reasonable notice <br /> 28 thereof, defend and pay the expense of any suit which may be <br /> commenced against the City of Everett by any third person <br /> 29 alleging injury or loss by reason of such acts and omissions and will <br /> pay judgments which may be obtained against the City of Everett <br /> 30 in such suit. <br /> 31 <br /> is hereby amended to read as follows: <br /> 32 <br />
