-47 i <br /> 1 <br /> 11 <br /> .1CONCOMITANT AGREEMENT TO REZONE ORDINANCE NO. •j L.2 I <br /> 11 <br /> lx 1981, b <br /> This Agreement, made and entered into this `- day of , y <br /> !, and between the City of Everett, a municipal corporation, hereinafter called <br /> the City and Evergreen Management Company, owner, hereinafter called the <br /> i' Company, WITNESSETH: <br /> WHEREAS, the City has made application for a change in the <br /> classification of the land west of Evergreen Way and east of Holly Drive <br /> i. located on the north side of 100th Street, located in the City of Everett and <br /> the County of Snohomish, Washington from R-3 Multiple-Family, Low-Density <br /> I I <br /> Residence to C-1 General Commercial and, <br /> 1WHEREAS, the said rezone contemplated will necessitate that the <br /> i <br /> Company will meet all the conditions specified on said legal described <br /> i <br /> property: <br /> i <br /> I <br /> That portion of the S Y2 of the SW Y4 of S. 13, T. 28 N., R. 4 E., W.M., described , <br /> as follows: <br /> I Commencing at the southeast corner of said SW %4: then N 0° 45' W to the <br /> north right of way line of 100th St. S.W.; thence westerly along said north right <br /> of way line of 100th St. S.W. to an intersection with a line that is parallel with <br /> and 135 feet southeasterly of the southeasterly right of way line of Holly Drive <br /> to the True Point of Beginning; thence N 45° 05' E parallel to and a distance of <br /> 135 feet perpendicular to the Easterly right oo way line of Holly Drive a <br /> distance of 347.75 feet more or less; thence S 0 45' E a distance of 260 feet <br /> more or less, to the North right of way line of 100th Ave. S.W.; thence <br /> 1. The Company shall provide protective screening as per Zoning Code <br /> requirements Section 19.42.030 EMC. The screening shall be not less <br /> than seventy-two inches in height when abutting or adjoining property in <br />): any R Zone.
