• ORDINANCE NO. --/,!) -, ` / AN ORDINANCE providing for the vacation of a portion of the Easterly 3.00 feet of 18th Avenue West (Loganberry Lane) from West Casino Road South a distance of approximately 480.0 feet. WHEREAS, the City Council of the City of Everett did by Resolution No. 1865 duly adopted and fix the 10th day of December, 1980, at 8:30 a.m., for the public hearing; and WHEREAS, due and legal notice of the time and place of said hearings and determination of said Resolutions has been given by the City Clerk in the manner prescribed by law; and WHEREAS, at the time and place fixed for favorable statements and objections to the vacating of the herein described street were heard and discussed; and WHEREAS, City Council finds, as a result of said public hearing, that the street vacation provides a public benefit and that the public interest is served thereby; and WHEREAS, it now appears to the City Council of the City of Everett that the portion of said street resolved to be vacated should be vacated; NOW, THEREFORE, THE CITY OF EVERETT DOES ORDAIN: Section 1: That portion of 18th Avenue West (also known as Loganberry Lane) according to Plat of Beverly Berry Tracts No. 2 recorded in Volume 10 of Plats page 20 described as follows: Beginning at the Northwest corner of Tract 35 of said plat, said point being a point on the east right-of-way of 18th Avenue West; thence South along the east right-of-way line a distance of 22.37 feet to the true goint of beginning; thence continue South 479.84 feet; thence N 11 08'36" W a distance of 2.26 feet to a tangent point of a curve; thence on a curve to the right having a radius of 175.00 feet and a central angle of 10°45'00" an arc distance of 32.83 feet and point of tangency; thence N 00°23'36" W a distance of 432.23 feet to a tangent point of curve; thence on a curve to the right having a radius of 25 feet and a central angle of 30°38'52" an arc distance of 13.37 feet to the true point of beginning; Said point being on the arc of a 25 foot radius curve having a central angle of 90°18'16" and consuming a distance of 39.40 feet to a point of tangency with a line which is 40 feet South of and parallel to the center line of W Casino Road. Section 2: The City of Everett, its successors or assigns shall not be responsible or liable for storm drainage runoff existing drainage patterns as established on City rights-of-way that may now or in the future go over, under, or across the above described alley vacation.
