Jsa_ g/ <br /> 2 <br /> AN ORDINANCE amending Ordinance No. 724-80 to include the Dwelling <br /> 3 Construction Under The Uniform Building Code, 1979 Edition, as an <br /> appendix to the Uniform Building Code, 1979 Edition. <br /> 4 <br /> 5 <br /> 6 WHEREAS, the City Council adopted Ordinance No. 724-80 which provided for <br /> 7 the adoption of the 1979 Uniform Building Code; and <br /> 8 WHEREAS, the City Council desires to adopt the Dwelling Construction Under <br /> 9 The Uniform Building Code, 1979 Edition, as an appendix to the 1979 Edition of the <br /> 10 Uniform Building Code; and <br /> 11 WHEREAS, the purpose of the adoption of the Dwelling Construction Under The <br /> 12 Uniform Building Code is to protect the general public and is not intended to create a <br /> 13 duty to or in favor of persons individually; <br /> 14 NOW, THEREFORE, THE CITY OF EVERETT DOES ORDAIN: <br /> 15 Section 1: That Ordinance No. 724-80 is hereby amended by the addition of <br /> 16 the following sections: <br /> 17 <br /> Section 46: The 1979 Edition of the Uniform Building Code as adopted in <br /> 18 subsection 1 of Section 3 of Ordinance No. 724-80 is hereby amended by <br /> the addition of an additional appendix, that being the Dwelling <br /> 19 Construction Under The Uniform Building Code, 1979 Edition, which is <br /> hereby adopted. <br /> 20 <br /> Section 47: In the case of conflict between the Dwelling Construction <br /> 21 Under The Uniform Building Code, 1979 Edition, and the Uniform Building <br /> Code, 1979 Edition, the Uniform Building Code, 1979 Edition, shall <br /> 22 govern. <br /> 23 Section 48: The Dwelling Construction Under The Uniform Building <br /> Code is hereby amended by the addition of the following language: <br /> 24 <br /> It is expressly the purpose of this Code to provide for and promote the <br /> 25 health, safety and welfare of the general public, and not to create or <br /> otherwise establish or designate any particular class or group of persons <br /> 26 who will or should be especially protected or benefited by the terms of <br /> this Code. <br /> 27 It is the specific intent of this Code that no provision nor any term used in <br /> 28 this Code is intended to impose any duty whatsoever upon the City or any <br /> of its officers or employees, for whom the implementation or enforce- <br /> 29 ment of this Code shall be discretionary and not mandatory. <br /> 30 <br /> 31 -1- <br /> 32 <br />
