July 6,2018 <br /> Page 3 <br /> advanced by the Firm in representing you. <br /> Right to Court Review <br /> You have been advised that under Washington law, you have a right to request court review of <br /> the reasonableness of the Firm's fees upon completion of the case. <br /> No Promises <br /> You acknowledge that the Firm has made no promises or guarantees regarding the outcome of <br /> the Matter. You understand and agree that should a trial be required, the Firm has sole discretion <br /> to determine which member or members of the Firm will act as trial counsel. <br /> Withdrawal or Discharge of Attorneys <br /> Both you and the Firm have the right to end the attorney-client relationship at any time, for any <br /> reason, on reasonable notice to the other. <br /> If the relationship is ended by you, the Firm shall be entitled to a fee as well as reimbursement of <br /> the litigation costs advanced by the Firm as follows: If the Firm's legal services for you have <br /> been substantially performed as defined under Washington law at the time of termination by you, <br /> the Firm shall be entitled to reimbursement of the litigation costs advanced by the Firm and a <br /> reasonable fee for services rendered up to the time of discharge, which reasonable fee shall not <br /> be less than Hourly Fees and the Success Fee set out in this Agreement. If the Firm's legal <br /> services have not been substantially performed at the time of termination by you, the Firm shall <br /> be entitled to a reasonable fee for services based on a valuation of the Firm's services rendered <br /> up to the time of discharge, which reasonable fee shall not be greater than an hourly fee <br /> determined by multiplying the number of hours worked by attorneys and staff times their current, <br /> non-reduced hourly rates then in effect, as well as reimbursement of the litigation costs advanced <br /> by the Firm. <br /> If the relationship is ended by the Firm, the Firm shall be entitled to reimbursement of the <br /> litigation costs advanced by the Firm and Hourly Fees, and the Firm shall also be entitled to a <br /> reasonable success fee based on a valuation of the Firm's services rendered prior to termination <br /> if you ultimately recover money on the Matter within a reasonable time after termination. <br /> It is agreed that no settlement shall be made by you in such a way as to exclude the Firm from its <br /> contingent fee. No settlement shall be made without your consent. <br /> Dispute Resolution <br /> We appreciate the opportunity to serve as your attorneys and anticipate a productive and <br /> harmonious relationship. If you become dissatisfied for any reason with the services the Firm <br /> has performed, we encourage you to bring that to our attention immediately. If we perceive a <br /> problem with the representation, we will discuss it with you. Most such problems should be <br /> rectified by communication and discussion.
