property being a single-family residence surrounded by multi-family structures is <br /> a unique situation warranting a variance. (findings 3 and 9) <br /> 5. The variance requested is not against public interest, safety, convenience or <br /> general welfare. The Applicant's access off Wetmore Avenue will allow the <br /> reduction of parking required off-site and would not impact parking available for <br /> other properties in the area. (findings 6 and 16) <br /> 6. The grant of the variance will not adversely affect rights of other adjacent <br /> property owners or tenants. The abutting properties have direct access off <br /> Wetmore Avenue, and this will not change with the grant of the requested <br /> variance. The terms of EMC 13.16 would create an unnecessary hardship on the <br /> Applicant in that it will result in significant construction designs and engineering <br /> being done to accommodate the difference in topography, as well as control of <br /> the stormwater. (findings 6, 7, 9, 10, 15 and 16) <br /> RECOMMENDATION TO EVERETT CITY COUNCIL <br /> Based upon the preceding Findings of Fact and Conclusions and testimony and <br /> evidence submitted at the public hearing, it is hereby recommended to the Everett City <br /> Council that a variance be granted to Michael and Terri Brashler to allow vehicular <br /> access off 3514 Wetmore Avenue, Everett, Washington. The property, which is in an R- <br /> 3, Multiple Family Medium Density and in a Core Residential Area, is developed with a <br /> single-family residence. As indicated in the Findings and Conclusions of this document, <br /> it has unique circumstances that warrant the grant of the requested variance. The <br /> variance should be granted subject to the following conditions: <br /> 1. The Applicant shall be required to secure all necessary permits. <br /> 2. The application shall be reviewed by the City of Everett Planning <br /> Department to impose any other conditions that the City feels necessary <br /> to develop the site. The City, in its review, shall determine if the driveway <br /> should have limited, if any, vegetation in order to provide unobstructed <br /> views of the sidewalk for egressing and ingressing vehicles. <br /> 3. The Applicant shall consult with the City of Everett Public Works <br /> Department to determine what requirements are necessary for the <br /> construction of the driveway over the curb on Wetmore Avenue. <br /> The City has established a process for improving streetscapes in multi-family <br /> neighborhood infill areas. The detailed long range comments of the City of Everett <br /> Planning Department(exhibit 9) provided information that the City has a streetscape <br /> plan that includes control of driveways. However, with the enactment of EMC 13.16.110 <br /> that allows the Everett City Council to grant variances from regulations and <br /> requirements of the Driveway Chapter, it is clear that the City by enacting the legislation <br /> for driveways and driveway standards in the Core Residential Areas recognized that <br />
