The City will have the right to make any terminated portion of the City Poles <br /> available for use to other parties as of the effective date of the termination, <br /> even if Company's Site Equipment is still on the City Poles.Upon termination <br /> of this Agreement, Company will remain liable to City for damages in an <br /> amount equal to the Rent and other sums that would have been owed by <br /> Company under this Agreement for the balance of the then-current term. <br /> Further, Company will remain liable for Rent as long as the Site Equipment <br /> remains on City Poles unless the City has authorized abandonment of such <br /> Site Equipment. <br /> 29.2.3. Termination of Site License Addendums. If an Event of Default specific to <br /> one or more Site License Addendums is not cured by Company within the <br /> applicable cure period, City may terminate such specific Site License <br /> Addendum(s). <br /> 29.2.4. Default Fees. Without limiting City's rights and remedies under this <br /> Agreement, the City may require Company to pay the following default fees <br /> ("Default Fees") in the amount of$100 per day, upon Company's failure to <br /> cure, pursuant to Section 31, any of the following: <br /> (i) Company constructs or installs any alteration or improvement without <br /> City's prior consent; <br /> (ii) Company fails to make a repair on a timely basis; <br /> (iii) Failure to meet FCC regulations; <br /> (iv) A material breach of this Agreement; or <br /> (v) Failure to provide reports or notices pursuant to this Agreement. <br /> 30. Termination <br /> 30.1. City's Termination Rights <br /> 30.1.1. Subject to the cure provision of Section 31, the City has the right to terminate, <br /> this Agreement or any Site License Addendum upon sixty(60)days written <br /> notice if the City determines that Company's exercise of its rights under this <br /> Agreement: <br /> a. Interferes with the City's use of the City Poles and/or the structures <br /> on the City Poles for the municipal purposes for which the City owns <br /> and administers such structures/site, which may include without <br /> limitation the necessity to widen a street or for other municipal <br /> projects that result in removing the City Pole; <br /> b. Poses a threat to public health or safety, constitutes a public nuisance. <br /> c. The City determines that Company's exercise of its rights under this <br /> Agreement interferes with the use of the City Poles or structures <br /> New Cingular Wireless PCS,LLC 24 <br />
