Y <br /> RESOLUTION NO. 6610 *W4 <br /> A RESOLUTION authorizing recovery of abatement costs <br /> pursuant to EMC 1.20.090 at 929 Pecks Drive, Everett, Washington. <br /> WHEREAS,the Everett Municipal Code (the"EMC") Section 1.20.090 authorizes the <br /> City to abate code violations and recover the abatement costs; and <br /> WHEREAS, on November 15, 2012, the City of Everett Violations Hearing Examiner <br /> issued an Order against the property owner(the "Respondent") for EMC violations at 929 Pecks <br /> Drive (the "Property"), parcel number 00393200702002, and abbreviated legal description: <br /> BEVERLY HILLS DIV 4 BLK 007 D-02 BLK 7 LOT 20 LESS W 70FT ALSO LESS 6FT THOF PER <br /> SWD 853/346 <br /> WHEREAS the Respondent failed to abate the violations, including garbage, trash, <br /> household items, bicycles, automotive parts and salvage materials accumulating on the exterior <br /> of the property, by the date set by the Order. <br /> WHEREAS,the property owner agreed that the City would abate the violations at his <br /> cost, and that those costs together with any penalties imposed by the Hearing Examiner may <br /> become a lien against his property if he failed to reimburse the City the abatement costs. <br /> WHEREAS,the City incurred costs in the amount of$2,618.94 in its abatement of the <br /> violations and attorney's fees and other costs in the amount of$391.50 and the Hearing <br /> Examiner imposed a penalty of$1,500 against the Respondent; and <br /> WHEREAS, notice of Council's consideration of this Resolution was provided to the <br /> property owner; <br /> NOW, THEREFORE,BE IT RESOLVED by the City Council of Everett that the <br /> costs and penalties set forth in the report attached hereto is confirmed for the Property.
