FINDINGS OF FACT 1. Gene P. King, Respondent, is the owner of record of property at 929 Pecks Drive, Everett, Washington (property). The property is in an R-2, Single-family, medium density zone as established by the City of Everett. (Exhibit#6, Snohomish County Assessors Record dated November 6, 2012) (Exhibit#7, Go Sync Map) 2. On September 5, 2012, the City of Everett Code Enforcement (ECE) Unit received a complaint of an accumulation of garbage and debris on the property. ECE Officer Fagerstrom conducted a site inspection and observed and photographed household debris,junk, trash, furniture, bicycles and overgrown vegetation in the yard of the property. ECE Officer Fagerstrom spoke to the Respondent who stated that he would have the entire yard cleaned up within two weeks. On September 27, 2012, ECE Officer Fagerstrom conducted a follow-up inspection and observed and photographed that conditions remained the same as the September 5, 2012 inspection. (Exhibit#2e-2f, Inspection Photos dated September 27, 2012) (Testimony of Code Enforcement Officer Fagerstrom) 4. On October 3, 2012, a violation citation was issued to the Respondent for a violation of Everett Municipal Code (EMC) 8.20.020. Copies were mailed to the Respondent via first class and certified mail and a copy of the citation was posted at the property. On October 24, 2012, ECE Officer Fagerstrom conducted a follow-up inspection on the property and observed and photographed that conditions remained the same as previously noted on September 27, 2012. On November 13, 2012, ECE Officer Fagerstrom conducted a follow-up inspection of the property and observed and photographed that conditions remained the same as during previous visits to the site. The Respondent had been given the opportunity to correct the conditions and received adequate notice to appear at this hearing to contest the City's findings.
