8 <br /> ORDINANCE NO. <br /> An Ordinance Amending Ordinance No. 3204-10,an Ordinance Rezoning Property Located on the East <br /> Side of Airport Road,South of 112th Street with a Development Agreement,Amending Ordinance No. <br /> 1671-89(as amended) <br /> WHEREAS,Ordinance No.3204-10 rezoned property from M-M (Business Park)to C-2 (Heavy <br /> Commercial-Light Industrial)with a Development Agreement;and <br /> WHEREAS,Ordinance No. 3204-10 included a parcel zoned C-1(General Commercial)that was not <br /> rezoned, but was included in the required Development Agreement of the Ordinance; and <br /> WHEREAS,Section 2 or Ordinance No.3204-10 subjected use of the site and the current or future <br /> structure(s)to conditions and requirements of a Development Agreement attached as Exhibit C;and <br /> WHEREAS,the Development Agreement, entered into on the 10th day of January, 2011,set standards <br /> and conditions to be applied to the redevelopment, including the C-1 parcel;and <br /> WHEREAS,Ordinance No. 3270-12 rezoned the parcel now owned by Sonrise Christian from C-1 to E-1 <br /> (Evergreen Way);and <br /> WHEREAS,the Development Agreement was never recorded,which did not allow the new property <br /> owners,Sonrise Christian Center,to be made aware of restrictions in the Development Agreement; and <br /> WHEREAS,the standards and conditions of the Development Agreement are no longer needed,as the <br /> current zoning of E-1 addresses development standards adequately; and <br /> WHEREAS,other property owners within the area subject to the Development Agreement are <br /> supportive of the proposed amendment to exclude the parcel owned by Sonrise Christian; and <br /> WHEREAS, public notice and opportunity to comment on this amendments was provided through notice <br /> to interested parties, a legal notice of public hearing published in the Everett Herald on June 1, 2018, <br /> and a public hearing held by the Planning Commission on June 19,2018; and <br /> WHEREAS,the Everett City Council held a public hearing to consider public input. <br /> NOW,THEREFORE,THE CITY OF EVERETT DOES ORDAIN: <br /> Ordinance No. 33 Sonrise Christian <br />
