Workman, owner, hereinafter called the Sponsor, WITNESSETH: <br /> IiWHEREAS, the Sponsor has made application to the City for a change in the classi- <br /> 'jfication of the land abutting and lying east of the intersection of Grand Ave. and 37th <br /> ;►Street, approximately one block west of Rucker Ave., located in the City of Everett and <br /> !ICounty of Snohomish, Washington from R-1 Single Family Residential to R-4 Multi-Family <br /> High-Density Residential and, <br /> WHEREAS, the said rezoning contemplated will necessitate all the conditions speci- <br /> ified on said legal described property, Friday First Addition to Everett Blk. 010, D-00, <br /> tract designated as Park on the face of the Plat, located in Blk. 13, that portion lying west <br /> I of lots 17, 18, 19, 20, and 21. <br /> NOW, THEREFORE, in consideration of the City Council of the City of Everett <br /> changing the classification of the above described property from the R-1 Single Family <br /> ' Residential to R-4 Multi-Family High Density Residential, the Sponsor hereby convenants <br /> and agrees as follows: <br /> 1. A parking, access and landscaping plan shall be approved by the Planning and Public <br /> Works Departments prior to issuing any building permits. The plan shall include the <br /> following: <br /> a. A five foot wide landscaped area around the perimeter of the parking area. <br /> b. A minimum of 5% of the interior area of the parking lot shall be landscaped. <br /> c. All landscaped areas shall be maintained in an orderly manner in conformance <br /> with the City of Everett Zoning Code (19.40.050D). <br /> !I d. The existing access from 37th north to Grand Avenue must be either <br /> maintained at its existing location or relocated in a manner acceptable to the <br /> Public Works Department. <br /> 2. This agreement shall run with the land covered hereby and shall be binding upon the <br /> successors and assigns of the Sponsor.
