fp <br /> RESOLUTION NO. 6625 <br /> A RESOLUTION authorizing recovery of abatement costs <br /> pursuant to EMC 1.20.090 at 212 76th Place SW, Everett, Washington. <br /> WHEREAS,the Everett Municipal Code (the"EMC") Section 1.20.090 authorizes the <br /> City to abate code violations and recover the abatement costs; and <br /> WHEREAS,on January 10, 2013,the City of Everett Violations Hearing Examiner issued <br /> an Order against the property owner(the"Respondent") for EMC violations at 212 76th Place SW <br /> (the "Property"),parcel number 00631300000500, and abbreviated legal description: <br /> VIEW CREST DRIVE BLK 000 D-00 - LOT 5 <br /> WHEREAS the Respondent failed to abate the violations, including vacating the <br /> residence on the property because it lacked the required utilities and did not have proper <br /> plumbing and electrical systems,by the date set by the Order. <br /> WHEREAS,the International Property Maintenance Code authorizes the code official to <br /> order a vacant structure that is unfit for human habitation and occupancy to be properly secured <br /> from entry, and may cause property to be secured at the owner's cost, if the owner fails to do so <br /> within a specified time; and <br /> WHEREAS,the cost of properly securing a property together with any penalties <br /> imposed by the Hearing Examiner may become a lien against the property in accordance with <br /> EMC 1.20.090. <br /> WHEREAS,the City properly secured the Property on 76th PL SW after notifying the <br /> property owner to secure the Property, and the owner failing to do so; and <br /> WHEREAS,the City incurred costs in the amount of$1,019.53 in its abatement of the <br /> violations and the Hearing Examiner imposed a penalty of$2,000 against the Respondent; and <br /> WHEREAS,notice of Council's consideration of this Resolution was provided to the <br /> property owner; <br /> 1 <br />
