• <br /> • <br /> 1 a violation of such ordinance or codes, the <br /> 2 Fire Chief, Building Official or their author- <br /> 3 ized representatives may, upon presentation of <br /> 4 their proper credentials, enter such buildings <br /> 5 or premises to inspect the same or to perform <br /> 6 any duty imposed upon him by ordinance only after <br /> 7 forty-eight hours of advance notice has been <br /> 8 given by certified mail and requested return <br /> 9 receipt outlining reasons and the time for ins- <br /> 10 pection and stating that the property owner has <br /> 11 the right to refuse entry subject to review by <br /> 12 a court of competent jurisdiction , provided <br /> 13 however, this section shall not be applicable <br /> 14 to emergency situations endangering the persons <br /> 15 or property, and provided further that the <br /> 16 forty-eight hour advance notice may, in the <br /> 17 discretion of the appropriate inspecting officer, <br /> 18 be dispensed with in the inspection of buildings <br /> 19 or structures under construction, repair, alter- <br /> 20 ation or removal or in the inspection of any <br /> 21 abandoned building. <br /> 22 In the event the owner and/or occupant <br /> 23 refuses entry after such request has been made, <br /> 24 the official is empowered to seek the assistance <br /> 25 from any court of competent jurisdiction upon <br /> 26 notice to said owner and occupant. <br /> 27 Section 4 : Section 205 of the Uniform Code for the <br /> 28 Abatement of Dangerous Buildings is hereby amended by deleting: <br /> 29 <br /> 30 <br /> 31 <br /> 32 -5- <br />
