• <br /> • <br /> • <br /> 1 (6) In the event that any such person seeking a review before the Fire <br /> Prevention Review Board fails to comply with all of the steps <br /> 2 herein set forth, then any member of said Board of Appeals or the <br /> City Attorney for the City of Everett may dismiss such appeal upon <br /> 3 motion and if all of the steps for appeal have not been complied <br /> with, the appeal of such party shall be dismissed by the Board of <br /> 4 Appeals. <br /> 5 (7) If such appeal is properly taken, the Board of Appeals shall, within <br /> seven days review such order and file their decision thereon. All <br /> 6 members of the Board of Appeals shall have a vote in arriving at <br /> such decision, except the Fire Chief, and in the event such order is <br /> 7 sustained by a majority of the Board of Appeals, it shall be <br /> forthwith complied with, or as modified by the Board of Appeals if <br /> 8 such modification order is entered. Unless by the authority of the <br /> Board of Appeals such order is revoked or modified, it shall remain <br /> 9 in full force and effect and be complied with within the time fixed <br /> in said order or decision of the Board of Appeals. All decisions of <br /> 10 the Board of Appeals shall be final. <br /> 11 <br /> Section 22: Section 2.107 of the Uniform Fire Code is hereby amended by <br /> 12 <br /> deleting: <br /> 13 <br /> 14 Whenever necessary to make an inspection to enforce any of the <br /> provisions of this Code, or whenever the Chief or his authorized <br /> 15 representative has reasonable cause to believe that there exists in any <br /> building or upon any premises, any condition which makes such building or <br /> 16 premises unsafe, the Chief or his authorized representative may enter <br /> such building or premises at all reasonable times to inspect the same or to <br /> 17 perform any duty imposed upon the Chief by this Code; provided that if <br /> such building or premises be occupied, he shall first present proper <br /> 18 credentials and demand entry; and if such building or premises be <br /> unoccupied, he shall first make a reasonable effort to locate the owner or <br /> 19 other persons having charge or control of the building or premises and <br /> demand entry. If such entry is refused, the Chief or his authorized <br /> 20 representative shall have recourse to every remedy provided by law to <br /> secure entry. <br /> 21 <br /> "Authorized Representative" shall include the officers named in Section <br /> 22 2.104, 2.105 and 2.106 of this Code. <br /> 23 No owner or occupant or any other person having charge, care or control <br /> of any building or premises shall fail or neglect, after proper demand is <br /> 24 made as herein provided, to properly permit entry therein by the Chief or <br /> his authorized representative for the purpose of inspection and <br /> 25 examination pursuant of this Code. Any person violating this subdivision <br /> shall be guilty of a misdemeanor. <br /> 26 <br /> 27 and inserting in its place: <br /> 28 Whenever necessary to make an inspection to enforce any provision of this <br /> 29 ordinance, the Fire Marshal or his authorized representative may enter <br /> any building or premises as prescribed in Ordinance No. 315-74. <br /> 30 <br /> 31 <br /> 32 -11- <br />
